CSA 'overpayment' of £20,000!

    If the CSA chase NRP's for arrears, then it's only fair to chase the PWC for overpayments surely?

    Overpayments should not arise in the first place.This is because of CSA incompetence.

    You could understand two to three months perhaps and then the overpayment could be adjusted promptly, but in this case seven years?

    Like I've said before the CSA negotiate with NRPs. Not so PWCs.

    Oh I agree it shouldn't happen, but with the CSA it's not surprising! How they have been allowed to continue with the level of incompetence they show is beyond me. Any other government body, private company, council, whatever, would have been closed down long ago! Even by normal government c*ck ups, it at the top of the list!

    if someone knows any different to me, could they post a link to a case of where a LO has successfully been awarded AGAINST a PWC????

    i physically know 3 pwc who were overpaid (admittedly, not 20k!!) and the gestapo were screwed. in 2 cases they asked them to make arrangements to pay, so nothing happened. and the third was informed of an overpayment, was on benefits at the time, they said they would take £5-10 a week, she claimed hardship and they haven't bothered her since.

  • If a case is closed as this one is they cannot force a PWC to repay any overpayment. If the pwc refuses to repay there is nothing they can do.

    A Reg10 (overpayment collection) can only be collected from ongoing maintenance with the agreement of the PWC.

    My main question would be if the case was closed why were payments still being take????

    Also if the NRP moved to Canada was he still working for a British company as he would still of been liable to pay no matter where he lived.

    Don't let the CSA bully you, half of them don't even know the rules they are working with so fight your corner.

    the enforcement measures they have only allow them to destroy nrp's.

    so the OP needn't worry. unless someone can post a link stating otherwise??? judging by the silence so far, i guess not........

  • I know this thread is old, but i registered just to say this.

    speedster is right, they can't force you to pay. The legislation was never put into place.

    Reg 10 no longer exists (it's a reg 8 and 9 now), and they not only don't need the PWC to agree to them, they can reduce payments to £0.00 if they want. This is only in the case where the NRP is still paying though, and it's to pay back the NRP the overpayment he's made. If the case is closed, and the NRP can prove he shouldn't have paid it (i.e. moved to canada), then he's due a refund. This comes from CSA coffers, although the rules have changed since this was posted making it stupid hard to get a refund.

    I worked for years for the CSA in one of their clerical offices up until late last year. Our offices would get the cases where 20k arrears would not be out of the ordinary.
