Wages paid to wrong account......

Afternoon all

A friend's boyfriend's got a bit of a problem that he's come to me with (I do payroll as part of my job and he seems to think that I can magically fix it for him :doh:) and I wanted some other people's opinions on it.

He just recently started a new job and the muppet gave the wrong bank account number - he's mixed up some digits or something. When he didn't get paid he went to the accounts dept who checked the records and that's when he found out he gave the wrong details. Now, he's kicking off because he thinks that his employers should re-pay his wages and sort out the missing payment themselves, but his employers aren't agreeing to this and have said that they'll try to get the money back but they can't make any promises.

I agree with his employers, and as harsh as it sounds, they have technically paid him to the account he provided so I don't think they should be out of pocket. But he isn't having any of it and is convinced that, by law, they have to make sure he has the money even if he's made a mistake.

I'd like to get some other opinions (or even links to legislation covering this if there are any) so I can either help him sort it out or just tell him to suck it up and stop whining.

ps In case I sound a bit unsympathetic, he still lives at home, has next to no bills and was planning on using this paycheque on a new set of alloys, so it's not like anyone's going to starve or be homeless if he can't get this money back.

You are right, he is wrong. Sorry but he doesn't deserve a more comprehensive answer than that - he f**ked up, he doesn't need the money, and if he thinks he's got legal rights he can go see a lawyer.

They haven't technically paid it into the wrong account, they have actually paid it into the wrong account. However it was the account he provided and as such, they have done nothing wrong.

Tell him to give them the correct account number and use it as a 'learning event' in his life to double check things.

Cheers guys, just what I thought. If he still won't believe me I'll tell him to go speak to a solicitor. I really don't know what my friend see's in him - he reminds me of Forrest Gump but without the endearing qualities and with a 'the world owes me' attitude. He's such a Kn*b-Jockey!!

Wow some lucky person is going to wake up to a mystery deposit in their account!

It's really hard to trace stray payments, I believe, unless the recipient comes forward.

to tell him that there's nothing he can do and he should chalk it up to experience and he just texted back saying that I'm wrong, I have no idea what I'm talking about and that he's 'going to get the jobcentre on them'. What he expects the job centre to do, I don't know but if he's being as gobby with his work as he is with me then he's going to find himself back on the dole again in no time :wall:

His employers need to contact their Bank and see if they have had a BACS rejection because the account number he gave may not actually exist, in which case the money will come back to the employers account in 3 working days. We used to re-issue the money once it had been confirmed as being recredited.

If the money has actually been deposited into a real bank account, then I feel your BF may want to hard cheese with his whine. They have done as instucted, so therefore I can't see how they can be liable for the loss.

I get the impression that the company can't recall the payment because it was a 'real' account number - hence the company's stance of we'll try but no promises. I think they're waiting to see if someone honest returns it.
