to tell him that there's nothing he can do and he should chalk it up to experience and he just texted back saying that I'm wrong, I have no idea what I'm talking about and that he's 'going to get the jobcentre on them'. What he expects the job centre to do, I don't know but if he's being as gobby with his work as he is with me then he's going to find himself back on the dole again in no time :wall:

The employers bank can write to the bank where the payment went to but then it's up to the 2nd bank to write to the lucky bank account holder who has suddenly woken up to extra money in their account.
IF they were honest they may call their bank to see where this money has come from.
If they do not come forward it will be for the bank to write to them but they can not take it back, only hope they will give it back.
The company are under no obligation to re pay the person whos wages this is untill the payment has been received back in their bank account. After all he provided them with the bank detail that's why in accounts and payroll you get all bank accounts written down by the payee and never take a number over the phone.
Oh yeah and there is the chance it was never paid as that combination of sort code and acct do not exsist but still that takes 3 days to return to the company0 -
This is interesting; I'd advise him to write your company stating that the money has been paid into the incorrect bank account and request a charge back, which he is willing to pay for. If i'm correct from memory the money can be recalled for upto 8 weeks after payment (I could be wrong). If they refuse, tell him to write to the bank where the account is held stating that sums paid into said bank account do not belong to the recipient and should they permit the account holder to spend the money he will hold them accountable to theft, id also consider mentioning this to the company (Although it is suicide) .. The account holder knows the money isn't theirs.. If that doesn't work, FSO...0

As a Payroll Clerk it never fails to amaze me how people can be so careless over such important details as their bank details or National Insurance number. Let him go and paddy off at the Solicitor or Job centre or whoever will listen. I think you have the answers above, the Employer will have to wait for a BACS reject or if the money has hit a valid account it will either come back or it won't depending on the account holder or if the money is untouched the bank may retrieve it.0

Regardless of whether a banks procedures permit discussion on the sum, the procedures do not prevent him from writing and ensuring the bank is liable should that money be spent...0 -
Agh I'm in this situation myself (not with work, but having paid the wrong account number because that was the account number the person we were paying gave us).
We called our bank the minute we found out he'd given us the wrong details but they couldn't stop the payment and said to call them in four working days when the payment had cleared. We called them on that day but they said that we had to wait another four working days because if the sort code and account number didn't exist then the money would automatically come back to us by then.
We waited and unfortunately the money didn't return so it seems that the account does exist.
I called my bank again and they've requested a 'trace' on the money, and they will contact the recipient's bank who will then ask for the money back. As another poster has said, the bank can not force this person who has our money to give it back and if they don't give it back then there's nothing anyone can do.
Still waiting to hear back from the bank on this and to be honest, I'm not hopeful!

Not that I am agreeing that MoreOn's advice is correct, but what's to stop him writing to the bank? It is his bank! Presuming as we have been told it was the wrong account number then the sort code is presumably correct and it will even be the same branch that holds the account into which the money has been paid, if it exists.0 -
