This isn't directly relevant to the OP's friend (because I don't think he would be able to take a complaint to the Financial Ombudsman Service) but it does give background information about misapplied banking credits.

FWIW, I agree with the OP - the employer paid the money to the account the OP told them to pay it to, and subsequent losses are not the employer's responsibility.

Why password.. would n't the name of the account holder do?

so for each transaction three peices of data needed

    1) sort code.
    2) account number.
    3) name of account.

basically the same way that cheques used to work, paid into a bank account of the named holder?

I can't help but think the advancement forward causes more problems than its worth...

The problem with the account holders name is that you introduce uncertainty.

How do you deal with all of these possible variants? Suppose it must be precisely "102345678 DV Shadow" and the payment is returned because it was given as "102345678 D V Shadow". People would be outraged at this being done because it it 'so obviously' right. By going for a public password, you eliminate the scope for these difficulties and the need to write reams of rules to cope with name variations.

I am proposing something along the lines of

which will not require rules to accommodate variants. Either it is right or it is not.

  • Some payroll software packages validate the sort codes, and also that the account number is valid for the sort code.

I'm sure BACS and the payroll industry would love to recode their systems to incorporate another stage of validations!

Why do we put up with these inadequate processes from the banks? Plainly mistakes can be made with account numbers and it is bound to go wrong. Even 40 years ago, companies were putting check digits in the order codes for items to stop this kind of mistake.

The guy gave the wrong sort/account code.

I fail to see how its a problem of the banks.

Thanks everyone for all your advise and help, but I think it looks like he won't be needing it......

I spoke to his girlfriend last night and she told me what really happened and it wasn't just a simple mix up after all.

It turns out that he had a bank account with Bank of Scotland a while back and ran up a ridiculous overdraft and loads of charges and it got so bad that he abandoned the account and opened a new one with RBS. When he gave his new job his account details he copied them off of the old BOS paying in book and not his new RBS one.

He had no intentions of paying off the old account and now the wages have been swalled up with charges etc and he's got no hope of getting the money out of the account.

I'm sooooo p*ssed off that I wasted my time and other people's trying to help him

Thanks again for your help, and hopefully this thread has at least helped someone else who's genuinely having trouble.

The immediate failure is the failure to provide a correct account number.

But we all know that these things are transcribed incorrectly from time to time. This could be an employee, a payroll office or indeed a bank.

So, if there is a simple system which could just stop money being transferred, it is indeed a problem which the banks could do something to assist with.

The question has to be asked. How did he manage to open a new bank account with RBS with such a bad credit history with BOS?

The two transactions could have overlapped. opened a new account before it went really bad because he knew it was going to go bad.
