I have been denied Housing Benefit backpay.

    Bit nosey I know but I am also an assessor and like fluffymovie said there is no way you could qualify with 26k p/a

    Is £300 plus CTC/ CB your total household income at present?

    Sorry i didnt add CB to this amount which is 20 odd quid a week!
    Not sure the exact amount it is.

    But that is everything i get, wages and CB, need to sort the CTC out.

    Your claim will have been calculated on this amount, not your annual salary.

    I wasnt sure if they would take this into account or not.

    I am rubbish and totally thick when it comes to all these calculations and entitlements, really dont understand any of it as i havent ever had to deal with it until i had my son in April.

    They look at your current income, not what you might earn over the year. So if you had asked whether you were entitled to HB on a salary of £26K, the answer of no would have been correct.

    Well i guessed that £26k was a lot myself as ive already said, hence why i didnt think i was entitled but now ive been asked what i getting at the moment it makes sense.

    All i really want sorted is my back pay now.

    But it does not seem that you would be entitled to backpay, as you were not misadvised?

    I wasnt given any forms to apply for HB until August after repeatedly asking the Council if i could get any help for my family since April.

    As explained earlier, all my advice was verbal so proving this is impossible.

    And when i put in for back pay the advisor i saw to give my application to told me i didnt need to give them any evidence of my financial situation that i had given her with my form as what i had written on the form would be enough.

    I thought she was wrong and im guessing she didnt help me much as i was turned down.

    It has taken 100 posts to get the correct information from you here. I would make an assumption that when asking for advice you were equally unclear, and hence advised of your entitlement based on a £26K income.

    I'm with Tory70, the chances of you receiving a back payment are slim to none.
