Can I sue HA for noise from neighbours?

  • unless its a move to a detached house... there will always be neighbours and we cant choose them. when i sit in my kitchen to eat, i can hear my neighbour having a wee next door..

    My point was about the greedy society we have become - if something doesn't go our way and there is someone to blame, we assume we can just sue them for it! It's ridiculous! Your neighbours have as much right to live in their home as you do, and you want to sue someone because they happen to be noisy and it causes you stress. Rather than looking for someone to blame (and sue), why not find a practical solution.

    Who is this "we"? Please don't include me in it. And why are you making additional issues such as:

    "Your neighbours have as much right to live in their homes as you do". I've never said otherwise, nor do I disagree with that statement. Why do you raise this? Have you decided that I want my neighbours evicted? If so, on what basis have you come across this knowledge?

    And:

    "...and you want to sue someone because they happen to be noisy..."
    Again, where has this come from? Please read my first post in which I specifically stated that my complaint is not against the neighbours, nor do I wish to sue them.

    I don't mean to be rude or to cause an argument, but if you are going to make a post, can you please stick to facts rather than making stuff up. If you disagree with me then fine - it doesn't bother me, but please at least read my posts before replying.

    Sorry to resurrect an old thread, but a friend has been round for a visit and said he cannot believe the noise from the neighbours. He's been back with a voice recorder that he's lent me which I've ledt on record for a minute or so at a time.

    I'll pop them on here as and when I can to demonstrate what i have to put up with. They have not been augmented, in fact the sound is quieter than it actually is in reality.

    you can get into trouble doing this. It will be inadmissable in a law of court as the people concerned have to be informed that you intend to use recording/monitoring equipment. You should delete that link

    You are going about this the wrong way. Noise nuisance/antisocial behaviour should be recorded on diary sheets. Im suprised you havent been informed of this.

    What are the HA and environmental health doing at present?

    If the noise is just a family going about their daily lives there may be nothing you can do.

    Another good way of exchanging is to advertise in your local paper on a regular basis. State that it is suitable for people with children as that is what you have around you.
    Could you go down to one bedroom?

    Are you over 50? you may be entitled to bid for something that is warden controlled. may be a bit quieter may not. Worth a try
    I wouldn't recommend it...I moved into a sheltered flat a year ago thinking I would be living a nice quiet relaxed life. So far, it's been a living hell...it seems like they're all profoundly deaf apart from me! The excessively loud tv's are above me,below me and on both sides of me.Don't go down the sheltered route until you are VERY hard of hearing then you won't suffer!:mad:

    There are sheltered one bed bungalows as well but you may have to wait.

    Environmental Health deals with noise regardless of whether it is youngsters partying or the elderly with the TV at top volume. There are plenty of gadgets available to help someone hear the television without disturbing the neighbours. They generally start out mediating, not writing threatening letters. Another avenue is a charity which supports the elderly and might be able to provide gadgets or grants for the same, or even approaching the manager of the complex.
