    so explicity "not new employers."

I don't do theoretical answers, I'd be here all day.

When OP comes back with more info I'll pop back.

fair point, but it wouldnt be much of a stretch to suggest they would provoke situations with new employers as well if they are already telling people.

but lets wait to see what op has to say.

Not if what they say is true and not misleading. Providing it passes that test then the consequences are irrelevant.

and if they are provoking the situation themselves by contacting new employers?
  • They have disclosed to the clients who use the services, these are not prospective employers.
It is happening because these people have been coming upto me in the city centre and telling me what my old employer has been saying.
When I had my appeal I was assured this wouldnt happen. I also agreed not to badmouth my former employer and I have stuck to this.
I just think it stinks basically.

Irrelevant unless what they are saying is untrue and / or deliberately misleading or if they are breaching some law or agreement in disclosing the information.

It doesn't matter one jot who contacted who. Either the information is correct and they are allowed to pass it on or it is not.

As was said so many times before on the other interminable thread (and please let's not go there again!!) if this information is coming from a former member of staff then there is nothing the firm can do about it.

I just want them to stick to what they agreed.

    That seems fair enough.

While it is fresh in your mind can you write down who you saw, when you saw them, and what they said?

I think a word with the employer would be best to see what they suggest before you engage lawyers.

Bottom line is if they are only telling the truth there may be little you can do in law. You don't have a compromise agreement, and they are not actually lying. But I would try and shame them into behaving better!

Well if there is I will deal with it accordingly, through getting advice etc. the information is coming from the current staff not former staff. Thanks all. Its o.k saying they are only telling the truth,I could go round telling the truth about them and ruin their reputation but I have chosed to be silent, like a decent person would be.
