My apologies in advance as I'm sure this has been asked and answered before, but I have searched and can't find the answer. I can see that the six years should go back from the date that you submit your claim to the courts but, prior to that stage what date should I go six years back from and presumably I will have to amend this if (probably when) I do submit my claim through the courts. Basically I am at the point of calculating all my Abbey charges (and working out the interest) and not sure what date to start going back from.
Many thanks.
In England, Wales and <?xml:namespace prefix = st1 ns = "urn:schemas-microsoft-comEngland, <st1:country-region w:st=" /><ST1:pNorthern Ireland</ST1:p, you can claim back 6 years from today. In <ST1:pScotland</ST1:p, you can claim back 5 years from today. However, today moves. For the Subject Access Request, it is from the date of your request. For the bank claim and the Financial Ombudsman, it is from the date of your first claim letter. For the court claim, the Limitations Act 1980 states that it is from the date you issue your claim.<O:p</O:pThe acquisition of wealth is no longer the driving force in my life.0 -
Many thanks for your response, that helps a lot. Am I right in thinking then, that since the account I am claiming from is now closed (so no further charges being incurred) but many charges were applied over the months around 6 years ago, that I may be better going through the ombudsman rather than the court? Since the ombudsman will look at the claim from the date of my first claim letter whereas if I go through the courts it will be from the date my claim is filed with them, which may mean that I lose the ability to claim a months worth of charges from July 2001 (by the time I've waited for Abbey to say no and then filed a claim with the court). Although I suppose if I'm claiming interest going through the court would enable me to claim more interest as I would recalculate everything on the day I submitted my claim.
