    If so is it the same process as in Martin's Guide?

  • You can claim for charges over 6 years however this site does not recommend that course of action. The problem with over 6 years claims is that the bank will claim under the Limitations act you cannot do so. You would need to prove concealment potentially and so it may be more complicated than you may want to do.

    Has anyone here tried to claim over six years of bank charges? I know some people are trying to do this and wondered if anyone here had been successful or tried to do it. From the little I've read, it seems the reason for not doing it is that the banks say they only have information going back 6 years. However, this seems not to be the case as some have found and I myself have received a list of charges that are prior to the 6 years they say they have.

  • There are a handful of cases that i know of that have been successful but i would say to you to take the simpler route first by claiming 6 years and then you can try for charges further back but you will need to read extensively about the statute of limitations act and concealment.

  • I'm guessing since I specified in my letter requesting a list of my charges going back six years Natwest only sent me six years worth of history since that's all they're obliged to do. Even if they did have further history it wouldn't be in their interest to give me that information.
  • I am at presant waiting to go to court with Lloyds tsb for £4,035 for the last 6 years charges but i still have thousands that i have paid to then going back further than 6 years. can i claim that back too? do i get all the statements from day one, calculate the amount and make a new claim? has this been done before? I hope someone can help me.

    Theoretically, yes. But you will have to argue a very good case against their solicitors about non-disclosure and the Limitations Act.

    In view of the amount involved, getting professional legal help, if possible on a "no win, no fee" basis might be a good idea.
    The acquisition of wealth is no longer the driving force in my life. :)

    I just went to my Halifax branch to ask for my statements & as I opened my account in 2000 but stopped using it in 2004 he said dont worry about it, they will pay up even though it is outside the 6 years!

    Result I say but time wil tell, he seemed very helpful! Think I will work out the dif between 2000 & 2001 & see if its worth it, then again I may have been good in my first year!!

    My apologies in advance as I'm sure this has been asked and answered before, but I have searched and can't find the answer. I can see that the six years should go back from the date that you submit your claim to the courts but, prior to that stage what date should I go six years back from and presumably I will have to amend this if (probably when) I do submit my claim through the courts. Basically I am at the point of calculating all my Abbey charges (and working out the interest) and not sure what date to start going back from.
