Hi, if you use a mobile phone whilst driving, do you get an on the spot fine or do you get a fine sent through the post?

    Believe you get something through the post. You also get three points on your licence...ha ha ha!!! Should be six or more.

    Should be an out and out ban for the prats ive seen flying around and almost causing accidents whilst chattering away on theirs :mad:

    I have now changed my mind to "ban the plonkers for minimum five years" - except bus/lorry drivers who should be banned for life immediately.

    You need to be 'pulled over' and the police will give you a ticket, (also called an on the spot fine) you don't actually pay it at the time, you have 28 days.

    You don't get points on your licence, it's non-endorsable.

    BUT...if you've been pulled over for using a mobile you may get charged with 'driving without due care and attention', the penalties for this are higher.

    It is still discretionary whether the officer decides to ticket/fine you or not. If you try and deny it, they can always seize your phone to trace the exact time the call was made/received to prove you were driving at the time

    at the end of the day it's a pointless law. By bringing in speed cameras the police can't police people using their mobiles as there are hardly any police on the road to catch them.

    You need to be pulled over and issued with a Conditional offer of fixed penalty. This at the moment is NON endorsable and will cost you £30 paid within 28 days. There is talk of making it Endorsable, which would mean £60 and 3 penalty points. The money goes straight to your district or county court, which then gets absorbed into the Council budget. The police do not get a single penny.
    If you can't say something nice - SHUT UP :p

    Na! I didn't want to start a debate or anything just curious as I usually use a hands-free kit but on a particluar instance I didn't. A policeman had a notepad and jotted something but he didn't pull me over. I'm not sure if a fine will come through the post.

  • How long ago was this? If it was more than, say a couple of weeks, then hopefully you've got away with it. He was probably just intending to run your VRM though the system to see if you had a list of road offences to add to

    it really annoys me to see people using mobile phones whilst driving

    but i dont think it should be illegal to use a mobile whilst parked - cant really see the logic in that bit

    e.g. i need to make an phonecall whilst on a journey but if i pull over and sit in the car to make the call - i am breaking the law?
    but if i park the car, get out of it and make the call thats ok?
    what if its dark and am in a rough area? :confused:
