    I didn't understand what I was doing at first, but I was glad my buyer stayed intouch with me, as the issue ended up being resolved amicably.

    To be honest, I wouldn't waste your time communicating with him - he doesn't sound like he understands or wants to understand. I don't think OP will get very far with trying to persuade him to refund voluntarily and should keep the case open.

    He doesn't care enough to do this amicably. If he were to come here we'd probably talk him round, but I think - with the best will in the world - it's going to be difficult.

  • Hi thanks for that, I responded yesterday basically saying I understand he posted however the proof is not valid and I haven't received anything, so I will be pursuing for a full refund, and its up to the seller to claim back from Royal Mail. Today I have received this reply.
    "i understand you want a refund but i will be sticking to what i have said i have proof of postage here in my hand so as far as i am concerened i posted this item to you, i can send you the recipt and you can dispute this with royal mail should you wish to but i dont have time to chase thse things im a full time worker and a single parent i sold you the item and posted the item as i should i have not done anything and there fore should not be punished for this
    What do I do now?
    Ideas,help and advice always welcome, judgements and assumptions are not!!

    You'll win the dispute as they can't prove delivery. What does it say in the dispute about getting a refund?

    Your seller is ignorant of the responsibilities she has towards her customers regarding non-delivery.
    She will be learning very fast when your claim is successful, and she has to make a claim using her proof of postage.

    Good luck and let us know how you get on. I guess it's probably ignorance rather than anything else, but I wonder how they would like it if someone did this to them.

  • Just out of interest, is the seller fairly new to eBay? Sounds like they just don't understand how it all works, they are responsible just don't reply anymore and as the seller can't prove you received the item eBay will find in your favour and you will get a refund.

    If my item fails to arrive, the first step i take is to raise a dispute with paypal. I put in the claim that the item has failed to arrive in XYZ amount of days.

    This gives the seller a kick up the rear to get themselves moving as they may ignore my eBay emails.


    My advice, Press on with the claim no matter what, the seller needs to show proof that the item was delivered by a trackable means. That means that paypal have to go online themselves and see that it was delivered.

    Without this, the seller will not win the dispute, and the cash will be snatched back from the paypal account. If the account balance is £0.00, then they will be taken into a negative balance which will lead to bailiffs etc if not brought up to £0.00,

    Hopefully you do give them a chance to respond first. This is something that more seasoned sellers and businesses learn to expect and so you might be jumping the gun by going straight to dispute and giving them a black mark on their account.

    Out of six issues in the last fifteen months, only one has actually gone to dispute and in that situation the seller was responding to emails but then disappeared round about the time she promised a refund voluntarily. The most recent person didn't respond to emails but she had posted the item - a week late - so it arrived with me before I could open anything.

    It is ultra-important you play fair - just like sellers' bad behaviour rebounds on the rest of us, so buyers' bad behaviour puts off a lot of sellers too.

    Many sellers who post on here post that they refund the buyer then await the outcome of the claim.

    Only time it happened to me was last year, during the bad weather. I did ask my buyer to wait as it was highly likely that the parcel had been affected by the weather but, after another week I refunded.
