Hi I need some advice, what are the chances of a baliff turning up at my house for refusing to pay my parking charge notice????
I got the fine for the alleged contravention as my ticket had fallen onto the dashboard and curled up so the details were not visible, I did stupidly contact them to appeal and emailed a copy of the valid ticket, this was done 3 times, I have had a number of letters threatening legal action and a letter and phonecall from Roxburghe debt collectors, I will still refuse to pay this as the amount (now £162) is totally unfair, and the landonwer has not made any loss, but am concerned at how far this will go.

Chance of a baillif turning up from Roxburghe, probably equal to you hitting the Moon with a snowball!
They would have to take you to court and win, then you refuse to pay as ordered. Seeing Mr Sobell [Roxburghe solicitor] doesn't turn up at court then that wont happen either.0 -
I recieved a phone from Graham White solicitors this morning,( 2 days after phone call from roxborghe debt collectors, very quick, I'm impressed) I refused to cofirm my address so they wouldnt speak to me !!!0

No you didn't ..you received a phone call from Roxburgh pretending to be Graham White !
Personally I'd tell 'em to stop harassing me and ef off or just get on with the court action ..as if ! lol0 -

As Sirdan posts, Graham White & Roxburgh are the same 'company', this is part of the scam process. They are not really 'Solicitors' either because they don't employ any lawyers but appear to have some sort of arrangement with a retired solicitor in his 70's who is quite infamous on this board!
Next time they call just say that the debt is denied and they should stop calling you as if they do then you will consider it harassment and inform the relevant authorities and the OFT and Trading Standards. They won't call you again!0 -

hope you don't mind me joining in thread I too received PCN from this company few days ago, I was all set to pay it £80! However completely disgusted at the price did a bit of research on computer and found everyone stating that private companies are unenforceable, its just an invoice at this stage and for it to become a charge it
I parked for 7 mins, in an area I work in (admittedly there were 4 signs in area)
I ran into a sales office to give keys back and a witness said a car had pulled up behind me when I wasn't there, placed a ticket on windscreen and went.
I did not see him.
I am very worried still but reluctant to pay this extravagant fine.
I called Trading standards they gave me advice but they can't obviously tell you what to do.
However felt they hinted that I should ignore.
I haven't contacted them at all yet!
Scared though now worried about baliffs and really do not want it to go to court and get a ccj on my file, all for the sake of this, but don't want to be a mug and pay it! help any advice appreciated!0 -

Correct.
Firstly, by way of reassurance, debt collectors have no more power than you or I to enforce a debt. They are desperate that you believe that they do but the fact of the matter is that all they can do, at the end of the day, is to simply to ask for the money. They will employ all sorts of scare tactics, capital letters, red ink and threats or hints of all types of unspecified action.
Secondly, unless you have received formal notice from the parking company under the terms of the Law of Property Act 1925 notifying you that they have sold or otherwise assigned the so-called debt to the debt collectors then the debt collectors are simply whistling in the dark and are powerless - regardless of what they hint at.
Thirdly, bailiffs are way, way down the road. The case would have had to have been taken to court, you would have had to have lost, failed to pay the amount ordered by the court within 28 days, the parking company applied to the court for a warrant and only then could the bailiffs become involved. That is just not going to happen anytime soon - and importantly - not without your full knowledge, assuming that you wouldn't defend the case in the first place.
Lastly, debt collectors are shameless chancers who make their money only when and if you pay. If, in the extremely unlikely event that a debt collector arrived at your door tell him to go forth and multiply. They cannot make you bleed, dance to their tune without strings and nor can they make you pregnant. They have no right to demand anything so give them nothing - including information.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
