  • I really think that you should at least try to explain to your landlord. He deserves at least that much. You may be suprised.

    Basically at this stage, owing three months of rent arrears and not being able to pay anything off it for at least three more months, you could well be out within 6 weeks. 14 days Notice to Quit, the landlord then applies to the courts, then possibly being granted possession in 14 days.

    This has all come about because I reported damp to my landlord but he has failed to act on it. I am witholding rent until he does something about it. This payment will cover getting a new place plus 80% of what I owe.

    He'll be getting my forwarding address so he'll get the other 20%.

    So as you can see, no freeloading, no deception. It's ok, I won't ask for an apology as some of you have been very helpful and non-judgemental, all I'm asking for is advice on whether I am still likely to be here when the payment comes through.

    Apologies for the patronising tone but when people think they know it all and dive in feet-first, I get annoyed.

    So from saying you can't discuss it with your landlord, to knowingly withholding rent because of a dispute that the landlord must be aware of is a whole different conversation. There are so many holes/contradictions on your "tale" I'm afraid you've lost all credibility as far as I'm concerned.

    If you'd have posted about a damp dispute and withholding of funds you'd have got a different conversation altogether, as it is, from your manner and the attitude of your posts I'd hazard a guess that you're your own worst enemy.

    First you said you are three months in arrears with rent due on 3rd month, impying that you have failed to pay the rent for 03/11/06 to 02/12/06, 03/12/06 to 02/01/07 and 03/01/07 to 02/02/07. Now you say you won't be three months in arrears until the end of this month - so when is the rent due and which months have you not paid for?

    You may have had different advice had you initially said there were repair issues with the property. People can only give advice based on what you post. If you withhold information (as well as rent), the advice may not be applicable to the situation.

    At one stage of my life I lived in a defective property, and witheld rent because necessary repairs were not made. I took care to deposit all the unpaid rent in a special account, so that I would be able to pay the full amount as soon as the work was done. Of course, I made sure that the landlord was aware of this.

    And no, I was not highly-paid at the time. I was unemployed, and for complicated reasons not entitled to JSA, nor to Housing Benefit. Towards the end I was living on an interest-free credit card, yet I made sure that I did not touch the rent money.

    (Just for the record, the landlord chose to sell the house rather than to repair it; I got a job in another town and ended up paying about half of the rent arrears, which the landlord accepted as full and final settlement.)

    Tenants like you are the very reason why I would never ever rent a property out. I wish your landlord luck in getting shut

    Like I said, it's a good job I'm not your landlord, as your excuses of witholding rent after being a day late wouldn't have washed with me and my legs would be fine, leeches don't scare me :)

    Lets hope your next place doesn't ask for a reference from your current landlord of whether you were a decent tenant or not!
