    Wenroe, I know you said you didn't want to get into why you have had problems on here but you could always post on the debt free wannabee board for some advice. Alternatively, we may be able to help?

    Thanks but this is already being worked on.

    In a nutshell, if I can still be here by the end of feburary then I'll be able to pay about 80% of what I owe and sort out somewhere else to live, so what I'm trying to do is find out if all the legal procedures will take around 6 weeks or more.

    It depends on when your landlord issues you with a notice to quit. If they do it immediately then theoretically if the courts aren't too busy you may be short by a week.

    However, you need to think about the landlord as well. They may have a mortgage to pay, other expenses etc that the rent you owe was due to pay for. I assume that you will be paying the other 20% owed. Plus there will be court costs of roughly £150 that could be assigned to you to pay. If you do not pay this then they can and may take you to court and chase you for the money.

    I've been told that the 14 day notice is only applicable if the rent is weekly - but I've been paying monthly - so I'm assuming it's going to be 2 months?
  • No, a section 8 on the grounds of rent arrears is different from a section 21. A s21 gives two months, a s8 gives 14 days.

    is it just me, or does anyone else think this is taking the mickey ?

    What you are doing is stealing from your landlord, and asking us to help you steal for another 6 weeks. If you had mortgage you would have been in court weeks ago and possibly out on the streets already.

    But, no, its ok to do what you are doing because its a private landlord ...........

    If you have not had income to pay rent - why have you not applied for benefit, or if you have real expectations of money due to you - gone to a bank and borrowed money or gone to friends - no, you just decide to use your landlord as an unofficial bank

    and before anyone asks, i am not having a bad day !!!

    They can't just throw you on the street though. It may end up going to court 2 or 3 times before they grant them possession. Have you been to see your local council? If not I would advise you to go there straight away and put yourself on the waiting list for council accommodation.
