Yellow line on sunday - 6 cars ticketed - any case for appeal?

    Some posters on here have no idea how useless Councils are, and are clearly far too quick to blame the motorist for their mistakes - what about Council mistakes? Funny how adjudicators would not agree with the 'blame the motorist' mentality; the fact is most people still consistently win Council PCN cases when they appeal all the way to adjudication.

    I just don't think councils getting it wrong should excuse sloppy, obstructive, dangerous or illegal parking. It's clear what the council's intention is and there is alternative parking provided within a few metres. People like the OP inconvenienced me every day for 5 years. Hitting them in the wallet might make them think a bit harder.

    I just wish councils would enforce the "no parking within 30ft of a junction" rules around here. People actually park over the corners and opposite the mouth of junctions which is incredibly dangerous. :mad:

  • We tend to agree with you but if the councils have got the lines/signs wrong then there is no offence committed. You could say we are doing them a favour for highlighting there errors so they can correct them, if they continue to ticket when they have no right to then we are right to try to help a victim avoid paying. I certainly agree about the junction thing, the worst ones around our way are mums dropping the ankle biters off at school, the normal road rules don't seem to apply to them.

    I'm happy to concede that, ultimately, I mis-read the sign and therefore I've paid the fine and that's that.

    However, whilst I'm sure it's unintentional, I feel as though I'm being portrayed as a dangerous car-parker, and being put in the same bracket as those who pose danger to school children.

    I can see why you were ticketed now you have shown the lines, not just a sign!

    But you were not 'illegally parked'. Most Councils enforce decriminalised parking and there's nothing illegal about it. You were alleged to have contravened a traffic order and you could have tried an appeal, but you paid.

    End of discussion I suppose.

    Seeing it is a single yellow line it is only in force at times, the council can not deem parking on it dangerous,obstructive or inconsiderate, or it would be a double yellow!

    The OP misread/misunderstood the signs. Its been an expensive mistake,one which I am sure they have learnt from.

    I do agree on the junction parking, we have a van always parks 10ft from a junction on DYL's near here, which makes it bl00dy dangerous to enter the junction as you cant see past it. People around here think DYL's are to make the road look pretty!
