tripping over dodgy pavement - possible broken wrist

hey guys, apologies if this is in the wrong section, feel free to move if this is the case.
on the way into work on friday I tripped over a very badly maintained pavement on the way into work and have subsequently been identified as possibly having a broken wrist, I was wondering if anyone had sued their local council for a similar accident or how I would go about doing it?
many thanks

I would suggest you take photos of the broken pavement then contact the insurance department at your local council to make a claim.0

How uneven are we talking here?! Given you are supposed to lift your feet when you walk, then height difference in the pavement would have to be quite substantial to show that it was the pavement's fault you tripped!
I'm a clumsy person, so tend to put things like this down to my own clumsiness, or not looking where I'm walking!
What financial loses are you going to be wanting to claim for?Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
Will you suffer any quantifiable losses from your broken wrist? Is it your dominant hand? Will you be unable to work?
Next time, you could just watch where you're going.0 -
I think (and I might be wrong) that the council would have to have been warned that the pavement was uneven and done nothing about it to be deemed negligent.

If the pavement is damaged by normal wear and tear. -- Not a lot of hope.
If work has been done on the pavement and not replaced properly. -- In with a chance.I used to be indecisive but now I am not sure.0 -
I would suggest that as an adult (presumably) if you don't think you're competent to make decisions about where is safe to walk you should stay at home.
Sorry if that seems harsh but it is what I think.0 -
I used to work for a 'no win no fee firm'. the rule of thumb was that if the pavement was less than an inch higher than its nearest paving slab - then you had no chance.
but! and its a big but - individual circumstances can break the rule.
first you have to get medical confirmation - so you saying its a suspected broken wrist is a bit suss - its either broken or or its not! A&E and the Xray dept will help here.
Then come back to the thread - and btw - I would be very suspicious that yours was a genuine claim! why? because most claimants with genuine claims have had Xrays - Real broken bones and say they 'just tripped' and dont say that the cause is 'badly maintained pavements'.0 -
Whatever happened to watching where you were going?
Why should the council fund your inability to watch where you're putting your feet?
And what budget do you want your compo to come out of, schools, social care, sanitary services?0 -
Have you actually had an x-ray as it seems strange that you say it's possibly broken. Unless a major defect then it is an accident and no-one is to blame. Hope you soon feel better.Lost my soulmate so life is empty.
I can bear pain myself, he said softly, but I couldna bear yours. That would take more strength than I have -
