Partners walks out leaving me with £1000 mortgage!!repossession or bankrupcy??

  • She was not my wife, just my partner who was joint owner on the mortgage. She walked out on me and left me for another man. I thought things were fine, obviously not. When she left we did have an agreement that I would pay the mortgage of her half of £500 and this would also be money towards our daughter too.

She changed the rules when she got the CSA involved and broke our agreement. So not only did I have to pay the full mortgage but also the CSA full amounts. She has it coming to her I guess due to breaking our initial agreement.

Have you had any legal advice? You are taking the right steps by contacting the mortgage people etc.

It is hard, but try not to get to distracted with anger and blame. Focus on what can help you - getting good legal and financial advice etc.

Good luck with sorting things out.

............You can't just rent the house out. You'll need either consent to let from your lender, or a BTL mortgage, which requires a 25% deposit. You'll also need to protect the tenants deposit, have gas safe certificates etc...

This is very important, have a look on the other boards about the problems people get themselves into renting out houses, when they don't follow the correct way.

    Good luck

So in theory does that mean they can go after the ex wife also? If OP can prove he has paid half then would they go after the ex or still go after the op as he is still in the house?

    Megan

Yes, they can pursue either or both parties for any outstanding debt regardless of who has paid what so far.

Thanks anselld. You would like to think that they would go after the half who haven't stuck to the agreement, but I guess that is not always the case.

I always learn something new on here!

If i do go bankrupt any pointers of what is a good move to take? Furnitre removed?? store money away (cash only)? run up credit card bills and max it out to go bankrupt?

I wouldn't take it to extremes by maxing out all possible loans, but simply stopping paying the mortgage would give you a fair chunk of money left over each month.
No reliance should be placed on the above! Absolutely none, do you hear?
  • Is it advisable that when i stop paying the mortgage i stash the money away somewhere? Or is this what most do and its the thing you shoudlnt really speak about??

If you are considering bankruptcy then I would recommend posting on the bankruptcy section and getting some advice from people who have been through it. And also reading about how in depth the OR looks at your finances, they will look back at your spending prior to going bankrupt and would certainly ask where the cash was being spent between you stopping paying the mortgage and going bankrupt

This is the bankruptcy section of the forum - http://forums.moneysavingexpert.com/forumdisplay.php?f=136
