What does the mortgage company say? If you were to pay only your half surely they should come after your ex wife for the remainder?
Also have you contacted the CSA about the fact you can not afford your payments? My ex only pays £308 per month for 2 kids and I know he earns about £40000 per year. (He has them most weekends too.) So, in theory, either you are earning a lot of money and can afford it or the CSA has got things wrong.

Both partners in a joint mortgage are liable (individually) for the whole amount. So the mortgage co can come after either person for the remaining half (or all of it if none was paid).0 -
I am waiting a response from my mortgage company and so that shall also determine the route in which i go on. But had no idea about the 25% thing. I am paying lots to get these tenants moved in from a new boiler of £300, estate agent fees and shower fixed and if i wanted to, icould ask for the half the expences to move them in but I can be hassled with that.
I have so much pride that i really dont want to go bankrupt. If i do go bankrupt any pointers of what is a good move to take? Furnitre removed?? store money away (cash only)? run up credit card bills and max it out to go bankrupt? No one I know have been bankrupt and I am so confused right now.0 -
So in theory does that mean they can go after the ex wife also? If OP can prove he has paid half then would they go after the ex or still go after the op as he is still in the house?

Sugar i have been paying the whole rent for 2 years but if things continue where i recieve nothing from her then they shall be getting nothing or just my half!
csa charge me this amount due to the fact I am on good money! All this good money im earning is just being wasted by the cost of the house, I cant even benefit from it.
Also I am assuming her partners assets are in his name because they are married and she is too dumb to not get a pre nup! If they got married but was in his name only then would they still come after his assets?0 -
After mid October I will no longer be living in the property just so you all know the tenants will be if everything goes ok, such as permission from her, mortgage lender etc.0

Charley007, There is no shame in admitting you need help sorting this out. No one will give you any medals for battling on with this difficult situation. I tried it once. It got me no where apart from into debt. Get your 'fighting' head on and stop letting your ex get away with it. She is also responsible. Things don't have to get nasty - but do think of yourself. There are never any winners in situations like this, but don't become the only looser either.

Thank you sugar you sound like my current partner. She has no idea why I am so nice towards her, she does make me extremly upset and hurt. However you and my partner are right and I should not struggle on my own when its a joint thing!0

There are two sides to every story of course, and we dont know why the OP broke up from his wife. Nevertheless she needs to have it spelt out to her that she is as liable for the mortgage debt as he is.
She appears to think that now she's moved out its no longer her problem, which couldnt be further from the truth.0 -
