Hi
Judgement has been made in my favour after the Bank failed to defend on time , so technically I have won !!---great £1,767.74 including £120.00 Court Costs richer........
however now I have to issue a warrant from my local court as Nat West have failed to pay up !!.do the Bailiffs actually attempt to take goods to the value of the debt to me, or do they issue a further summons?.
The Warrant paperwork is on its way to me after talking to the courts this afternoon.
will keep this site posted of outcome
Regards

Hi all,
just a quick question if a may:
I am just about to file my online claim with MCOL. In my two letters to the bank I calculated the interest using the calculator on this site and included it in my claim. Obviously the amount of interest will now be more as we are the best part of a month down the line.
Do I enter the individual charges in the calculaor again to get an accurate (up to date) figure on the day I log my claim?
I understand the daily figure being added, but if I don't recalculate it today, they could be getting away with some interest for the period between my first letter and the day of my MCOL claim...... and we don't want that do we?;)
Is this correct or am I going over the top??
Any help appreciated thanks
Yes I would do it again now before you do your claim then everything is up-to-date - Good luck0 -

Hopefully you made the claim against your local branch in which case of non-payment, you can send the baliffs in to recover goods and go and watch!0 -

It tells you a bit about this in the above link.
A. Warrants are not actioned immediately. The defendant's local court will receive your warrant. They will then write to the defendant to advise them a warrant has been issued and that they have seven days to contact the bailiff to make payment / offer of payment. If no response is received the bailiff will then visit the defendant's property. The time limit on this depends on how busy the court is, but this is usually within fourteen days. Warrants can take several weeks to action, as the bailiff may have to visit the property more than once.0 -

You need to wait for communication from the court. If the bank don't put in a defence then you can claim judgement by default but they are well known for entering at the very last minute! You won't be able to click to ask for a judgement until the time is up.
You should get the full amount if you pursue the claim. Virtually everyone who has followed through with the procedure has had a full refund.0 -
Do you always round up the daily interest rate up? Or can it be rounded down? Cheers0

You can round up or down depending on the figure.
For example if the figure is 0.22 you would round this down to 0.2 but if it was 0.25 or upwards you would round it up to 0.3.
Hope this makes sense :rolleyes:0 -
"return of the amounts debited of £324.00, Interest per S.69 County Courts Act 1984 of 8% - £20.13 continuing at 8% until judgment or settlement at a daily rate of £0.07"
Hope that helps
