first time posting so bear with me, have cut/pasted sample letter 7 into court forms moneyclaim site and it says too many characters over too many lines. am i being thick. please help me someone.0

sorry everyone..i'm onto my 4th mcol claim now..have sucessfully won 2 and have 1 still ongoing but its been a few months since i started my original claims and i can't for the life of me remember how to work out the daily rate of interest for the particulars of claim.
can anyone help?

hi got to fille at court on weds am on income support so wont pay fee but how do i do this can i still use MCOL or do i need to use court to claim exemption from fees?
No you can't use MCOL if you don't want to pay court fees as you have to prove that you are unemployed to the court by going there and showing the relevant documents that exempt you.Reclaimed thanks to this site:

I do not understand the simpler version... I cam claiming before interest £324.00. Plus £20.13 interest which makes £344.13. My first charge was on the 27/10/05 and opened the account on the 20/05/05, so i have tried to put what i can in...
The Claimant has an account 00939729 with the Defendant, opened 20/05/05. Since 27/10/05 the Defendant debited charges and interest in respect of purported breaches of contract.Defendant is aware of all details as a list of charges has already been supplied. Claimant contends: The charges exceed the Defendant's losses caused by the breaches; The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. Claimant claims: return of the amounts debited of £XXXX; Interest per S.69 County Courts Act 1984 of 8% - £xxx [enter interest total at date of claim] continuing at 8% until judgment or settlement at a daily rate of £0.xx; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court.

Hi Everyone,
started taking A @ L to court yesterday, on the moneyclaim website, used the suggested template, but found that it was too long, their is a max amount of characters 1080 i think and 24 lines in the claim box.... the template went over to about 1110 and 29 lines..... It took my son and myself nearly an hour moving all the words up and replacing the paragraph spaces plus we had to change one words from disproportionately to unduly, has anybody else found this problem, and maybe Martin could change the template slightly, because it looks like there are going to be LOTS AND LOTS of people using this template.0 -
My MCOL was deemed served yesterday got a letter from the court today aying the banks Solicitors are defending the whole claim is this standard when they sign for it? And this doesn't necessarily mean that it will go to court does it? I know hundreds of people will have asked already but haven't read the whole of this thread!! So now just sit and wait for HSBC to get their bums into gear and hopefully realise its not worth defending the claim. The OFT decision will that affect claims already in the system?

grrr this is frustrating....i've entered 3 other mcol claims now but i'm having trouble on my fourth..my particulars of claim has too many characters, i've copied and pasted the exact same wording i have used for my other 3 claims so i'm not sure why its not allowing me too keep this one. are there any setances/wording i can take out to shorten it?

Claimant claims: (a) return of the amounts debited of £140.00; (b) Interest per S.69 County Courts Act 1984 of 8% - £34.44 continuing at 8% until judgment or settlement at a daily rate of £0.031. 6. Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. 7. The Claimant therefore asks the court to enter judgment in their favour for the sum of £140.00 plus interest, amounting to a total of £174.44 8. Costs allowed by the Court.0 -
Hi all,
just a quick question if a may:
I am just about to file my online claim with MCOL. In my two letters to the bank I calculated the interest using the calculator on this site and included it in my claim. Obviously the amount of interest will now be more as we are the best part of a month down the line.
Do I enter the individual charges in the calculaor again to get an accurate (up to date) figure on the day I log my claim?
I understand the daily figure being added, but if I don't recalculate it today, they could be getting away with some interest for the period between my first letter and the day of my MCOL claim...... and we don't want that do we?;)
Is this correct or am I going over the top??
