i have registered mcol. been confused about next step, do i wait for court to send me paper work, i did read that i have to send an update letter to bank with schedule of charges and to the court, i have found the template. do i send same letter in template to bank, and what adrress do i use to send to court.0

Have you received any letters asking you for these details?

Hi all was wondering if sum1 could advise me with the following issue.
I received an offer from the bank which i am declining
ive been given me a reason as to why they wont pay some of the charges so what im thinking of doing is sending a new breakdown of charges excluding the charges which they say they wont pay
i just wanted to make sure that the exclusions that they are reffering to are valid and cant be claimed back or if they just dont want to pay them.so here they are.
they write: yr breakdown in charges includes an amount of £50 on 18 nov.this amount has been deducted because it is a reversal charge that we do not refund.(is this right?)
Also they write we have deducted charges totalling £58 from your claim as these have previously been refunded to your account(but i have been through my statement a thousand times and cant see where they have been refunded.Should i take their word for it?
do you think i should still persue with these to charges or should i remove them from my breakdown.
All help would be appreciated.0 -

I've been on mcol tonight to start taking abbey to court.
My charges were £3068 and they have given me back £853 as a gesture of goodwill . That leaves £2215 to try to get back.
the bit i'm stuck on is "particulars of claim" and how to word it.:o
I dont want to claim the interest so do i just leave that part of the question at £0.00. I never asked the abbey in my first 2 letters for the interest,just what they had taken. How could i evan add interest to £2215 as that was only some of the charges ..plus when they paid back the £853 it just appeared in my account!!and not showing which date they were from:mad:
so trying to use the interest calculater now is useless without the dates ..i think??
so any advice on how to fill out this " particulars of claim " section would be a big help to me.
I have read the help thread on this " particulars of claim " section,but it looks like in that template reply letter you have to put in interest??
It all seems a bit confusing now as i've been at this all night !!

Why don't you want to claim the interest? You could have invested the money they've taken in charges.
Whilst you weren’t legally entitled to the 8% “statutory” interest on the charges up to now, it can be awarded by the judge under the County Courts Act. Therefore, you really ought to add it to the claim now, along with your court fees.
One reason the banks and CCCs are making these last minute goodwill payments is to create exactly this kind of confusion.
Use the calculator in Martin's article, and then simply deduct the £853 from the total.The acquisition of wealth is no longer the driving force in my life.0 -

I submitted my MCOL for Halifax £750 yesterday - is it 14 working days or total days ? Will re-read the MCOL site again shortly as I know the answer should be on there.
girlfriends HSBC for £1500 is going to MCOL tonight.

Hi all..
I'm currently 22 days though the MCOL process (the bank has put in an Acknowledgement). I have received a letter this morning offering the full £494 minus the interest, as a good will jesture - though this letter has arrived at my old address, and not the one marked up as the correspondence address from MCOL...
I'm thinking that this means it is nothing to do with my ongoing court case, and its to do with the bank responding to my first two letters, saying you've got 14 days or I'm taking you to court...
Should I just hold out for a further 7 days when they'll owe me the £494 + interest + £80 court fee = £680
- that is if they dont defend in that time...!!
Any advice ?0 -
hi, I am in the middle of filling in the online mcol form, but I am unsure of the particulars of claim, what interest do i use, is it the one from the original online calculator, I am claiming £1500+ charges and £400 + interest, is it this interest I put on the form? am getting really conffused , which is not hard, lol

You use the online calculator, and do the calculation on the date you issue your court claim.
