my case is a bit different,I live in flats over a shopping precinct,when we first moved in the car parking was free,as it was for shoppers,then excel were invited in by the cheap tw@s that were running the precinct,nothing for the residents,there then followed 3 maybe 4 years of cat and mouse,moving vehicles early morning to avoid "fines" on car park,couldn't pay for tickets,it worked out at £147 a week for our 2 cars,£10 a day then 50 pence fore the night x 2 cars.
excel moved on and ecp are now our resident r soles, having followed this forum and learnt my lesson,towards the end of excels time tickets were ignored,as were roxboro,not sure of spelling,and graham white.
it is now ecp's turn to try and extort money from me,all tickets ignored,but now they have sent me something new,stating that should my vehicle be found on their car park again "the vehicle will be issued with a 7 day notice and removed by an approved contractor".
most of the above is "water off a ducks back" but this new move is worrying,has only been covered once on this site and the guy,jimi4567,did not complete the story,but this case is different to his.
sorry it has gone on for so long, but has anybody any experience of this,any anecdotal evidence,views,help in any form. I understand about signage etc,but as I say this new one (on me) is worrying.

Firstly, what does it say in the lease about parking? Does the MC have the right to charge for the parking in the first place? Get all info and head on over to pepipoo.com as this seems to be a convoluted one.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

There is a couple of interesting cases ongoing at the moment on other forums regarding this matter. Clamping for unpaid parking charges in its self would be illegal as they would have no legal claim to the money!
In one case NCP claim they did what Euro have done to you issued a ban from the land! Clamping and removal can be used as a remedy for trespass, whether a letter banning you would be sufficient to prove you were warned of their actions and accepted by you that you consented to being clamped would be a matter for a court.
I have seen a similar letter from Euro but the thread dried up so don't know the outcome.
The problem you have is the same as the ongoing NCP victim is having, if they did clamp and remove your car, it would mean you would have to issue proceedings to get it back.

having spoken to the management company rep on site there is,I'm told,nothing in my lease that entitles me to free car parking,why should there be?,parking was free when we first moved in.What is getting me is that,alright, I could go and shop somewhere else,if I worked on the precinct,I could apply for a transfer to another branch, but I HAVE to live in my home and therefor I have no alternative but to pay these people,and I suspect I am using the word in quite the wrong manner there, to park outside my own home and I feel,I think justifiably,as it was free when I moved in,miffed.0 -
The shopping precinct will have required planning permission, it is often written in the planning conditions that parking must be provided free as part of the development.
I would try a FOI search at the planning office for all documents relating to car parking and planning consent at the site.
If you turn anything up, you can then make a written complaint to a planning officer about breaching the conditions with each new breach representing 1 new offence and duly reported as such.Hi, we’ve had to remove your signature. Do the same people own your home as own the shops? [or manage them]
Also it would be worth finding out what the contract with Euro states.0
