Im not going to read the whole thread but have you possibly thought you gave the wrong answers for the questions. At the time you may have thought they were correct but when you think back they were'nt the best answer to make.
The fact you had to do the assessment despite working for m&s in the past is irrelevant, maybe the person who told you you wouldnt take the assessment made an error. They have to give equal oppurtunities to all potential employees.0 -

i can assure you tribunal cases have been won on far less conclusive evidence than that.
Which has not been done here - you're quite frequently wrong and this is a further example of your inaccurate advice. There was no such quantifiable proof of any discrimination whatsoever save for the fact he was disliked - which as i've pointed out was impossible to prove it was the case he was disliked over his colour and was most likely to do with being the new guy of the scenario.

So what do you want from them for it? It seems to me that they have got away with it and there's nothing you can do now to change that apart from write a letter and have them shrug and file it in the bin.I wasn't moaning about doing the work as im happy to do work as im looking to make myself better and knowning the cash i spent i have earned it. I have never moaned about the work i was doing, but looking back now, i don't see why i should let m&s get away with this,
Your assumption that a store with mainly white customers would not want a black person working there is grossly offensive. I am white and I don't care a jot what colour the person is who serves me in a shop or with whom I work. You should be careful of accusing others of racism unless you have very good evidence.0 -
You were employed previously in a non-customer facing role. They needed you to do the role play exercise to see how you would be with customers.
They decided they didn't like your customer handling (reasons already provided by others) and this, coupled with the way you left last time sealed your fate.

MDW I hope you will be able to take the comments on here as constructive, I used to work in retail and often when choosing an employee it does come down to how far you think a prospective employee will go in assisting a customer and overall manner ( better too much than too little...and in this case I agree offering a replacement and perhaps a 'sweetener' would have been better than a straight refund).
If it helps any I was once in a position to read the comments in an assesment of my training course after I had just joined the firm "Not particularly sparkling in looks or personality" LOL...but it didn't prevent me from getting swift promotion when it was apparent I could do the job well. I don't think for a moment you were discriminated against because of your race or colour...more likely there was someone else who 'gave the right answer' re the cake situation, and perhaps had more experience being a bit older?

most people here have stated that they hate the race card being played and while i am not black or ethnic minority, i do know that in tribunals playing the race card is very often an absolute winner and the best card you can play.
And this is based on what? The low number of discxrimination claim wins proven by statistiics? You know nothjing about tribunals, win rates or how tribunls operate. Encouraging people to submit frivolous claims (and ok - you do appear from previous posts to know something about that) is encoraging them to have costs awarded against them.0 -

To add to this point, I recommend using short, simple sentences. It is too easy to get carried away using complicated sentence structure and BIG words. The point of language (written or verbal) is to facilitate communication. Short and simple sentences will bring your point across in a clearer fashion.
To the OP, remember that hundreds of people might be applying for the same position and done the same interview. Even if you felt that you've done a good job, someone else might have done better. It does suck when your effort is seemingly not recognised, but you have to understand that others do not owe you a livelihood. You are in a position that you have to prove to others that you are worth hiring.
On an unrelated note, would "of" is a pet peeve of mine, mainly because I have no idea how this error came about. I can understand "your" and "you're" to an extent due to them sounding similar, but "would of" and "would have" are miles apart.0 -

I hate it too. I think it's because a) today's education is !!!!, b) kids can't be @rsed to learn and parents can't be @rsed to make them and c) 'of' sounds a little bit like 've. So "should have" becomes "should've" becomes "should of".
