Please help - I think my fake uggs sold for too much!!

Sounds a bit odd, but I'm worried my fake uggs sold for too much!

I listed them as honestly as I could, I think, and I've included 8 photos of the boots, the sole, the heel tag, the labels etc. Please would someone have a look at the below wording and tell me if the buyer could end up with the boots and her money back from PayPal?:

I'm just a bit worried, since they sold for a fair amount, that she'll be disappointed and open a dispute :(

Thanks in advance!

  • Why don't you email them and make sure they know what they've bought.

The info is there. Its upto the buyer to read the full discription/terms before making a purchase.

You could always email the buyer before dispatch to make sure they are awake they are 'fakes'. If they wernt, give them an option to negate on the deal.

I'd think they were real going from the title. Some people genuinely do not read a long description. Their fault I know, but ultimately the sellers responsibility. Maybe the winning bidder knows the score on eBay, and is hoping to eventually get them for nowt?

    That's what I'm frightened of...

There was a bidding war, and the losing bidder would (I suspect) be more than delighted with a 2nd chance offer.

I think I'll email the winner and make sure she knows what she's bought.

You have given all the info in the description, however if Deckers are what are commonly known as Uggs in the UK & you have called them Uggs in the title then that's what people will go by.
If the buyer opens a SNAD then you will no doubt lose.

If you've sold them as new in the UK then I strongly suspect that you are guilty of trademark infringement anyway.

And I agree with the poster above who said that the title is misleading, and the buyer may be someone quite savvy hoping to put in a claim because they are fake.

  • Ugg Australia is a trademark so putting it in the title is the equivalent of selling cheap shoes and putting Chanel/Prada etc. If they are labelled Ugg Australia and not made by Deckers then they are counterfeit. It is illegal to sell counterfeit items

Not sure how selling as new in the UK is an infringement? They are new - completely unworn. Am I being dense?!

Oh dear. I didn't realise that Deckers held the trademark for Ugg Australia, I thought it was just Ugg. I put Ugg Australia in the title because that's what they're labeled as... I don't think they're made by Deckers, nothing to suggest they are. I understand that they came from Australia, where (I guess) Ugg Australia isn't trademarked?

I also think you could potentially risl losing the boots and the money if the buyer is savvy- I'm just surprised your listing didn't get pulled.

'Ugg' boots are a real problem when selling and despite the legalities of trademarks etc if ebay get involved you might have to prove they are Uggs as sold- and ebay may consider that to mean genuine Deckers

Loads of info, including by the looks of it how to spot fakes.
