Audi GEARBOX fault within 3 months of purchase

    Some people dont half roll over easy.So if you went to CEX and bought a laptop for 500 quid and it packed up a week later thats tough because its second hand?

    Buying a laptop from CEX is hardly the same as buying a well used 9 year old car is it?

    whats the relevance? The first describes a major fault with perhaps a three year old SMART car, the second is about a clutch slipping less than a week after purchase?

    All these prove is that *sometimes it works out for people*

    Not really the same as a gearbox failure on a 100K+ miles 9 year old sports car?

    Not saying the O/P hasnt got a case, but i dont think by any means its cut and dried.

    If you take the sale price out of the equation, then it would definitely go against the O/P, however its probably going to go on how much weight the judge places on the price being £6495.

    We could debate this for months. It will take ages for this to be sorted.

    Again, if i was the O/P i'd probably have a crack at taking them to court

    Yes it is because the SOGA still comes into play for second hand goods and who's to say the laptop isnt well used,it could of been used 24/7 for 3 years solid?

    The smart car was well below the value of the OPs car.Of course it only "sometimes works out for people" if I tried to get a gearbox fixed by the dealer on a 500 quid car a year later then I wouldnt have a hope, but on a 6.5k car, regardless of mileage and age I'd expect it to be still driveable 2.5 months later.

    Completely different Scenario. That was a far newer car with far lower mileage - not one that is at an age and mileage that is classed as end of life by pretty much every manufacturer.

    And what was the point of posting that? Post 3 gives absolutely no information about the age and mileage of the vehicle. For all we know it may have been a 1 year old one from the main dealer.

    When you've an example which is comparable to the OPs cars age and mileage, then feel free to post it.

    Looking on Autotrader, that seems to be the going price for one of that age and mileage so its a bit hard to place weight on the price when its "what they are". And that seems to be the other part of the scenario that people seem to be ignoring.

    What difference does whether you got a bargain or not make? The issue is whether the OP has "rights" to get a "sold as seen" 9 year old car repaired for free.

    Shame its hard to find examples of where there was a resolution, either for or against, hopefully the OP will come back with the final outcome.

    Not that it’s really relevant but when I looked on autotrader up to 10 year old TT’s from traders started at about £1.7k and I think I had to go to about page 40 before I got to cars that cost £6.5 so I think your agreement that the OP paid the going rate is a bit thin.

    At the very least the OP paid well towards the top end (& probably over) the going rate and so can expect an above average car.
