You cannot terminate the contract without paying out the full remaining balance. In terms of the "cut off" period, it would seem reasonable once you have cleared the outstanding balances to ask for either a credit for the days you have then paid for on which service was unavailable, or for the relevant number of days to be added on at the end for no extra charge (in effect change your billing date). A contract is a binding agreement which you have no rights to simply abandon when your circumstances change. There is unfortunately no easy get out here.

What I want to hear is advice so if you have none to give then keep your sniping comments to yourself please. If there is nothing I can do then fine, I don't need people telling me it's tough that I can't pay my bills, I want guidance so if you have none to give then please can you just keep your opinions to yourself.

In fairness I think every respondant has given the correct advice and guidance, it is up to you which path you wish to take :o
  • Thank you Weston Dave. Might not be what I wanted to hear but was said without being condescending.

    Cheers.

I will try to give guidance, but you didn't do yourself, as a new member, any favours by referring to the customer services person as "an idiot" just because they didn't or couldn't give you what you wanted.

There are company policies in every network to deal with unemployment and inability to pay. Regrettably the stance is "It's not our problem and a contract is a contract".

You will have seen the annoying adverts for the "Credit Expert" with the Chinese manservant. They are informed every month of the current state of play with everyone's state of accounts and, unfortunately, yours will show as in arrears whatever you do unless you pay.

You can try writing to their chief executive to see if they will agree a different non-standard plan for you, but I fear that they will resist making precedents. You will find the email address on other threads on here.

I agree that you should sell the handset if it is a decent one and get a cheapo. That will give you some cash to pay off the account.

You won't need telling that taking on credit to pay for a shiny handset when things are going well is not a good idea when disaster strikes and I hope that next time you will go sim-free and weigh up what is really important.

Lastly, the people who responded to your posts are long time members who are very knowledgeable and help others, but, as I said earlier, your initial post put people's backs up and maybe if you read it again you might get the point.

    Hope the job situation improves.

Actually, I'd already said that in pretty simple terms above.

Ultimately I would like to know if there is anyway I can get out of the contract as I cannot really afford it any longer with all my outgoings increasing in the years since I have been with them.

I realise you're frustrated, but you need to try and take emotion out of it. If your ultimate goal is to avoid paying the remainder of a mobile contract(s) with some of the term still remaining, that's not likely to happen without evidence of serious debt problems.

There's a good second hand market for iPhones, so if you want out of the contract, my suggestion would be to sell them and use this to help pay off the remaining term. If a phone is essential, purchase a cheap SIM free device, they can be had for £20 or so.
