same thing happened to me with viking direct when i ordered a fax machine. they sent me 2 but i was only charged/invoiced for 1. i contacted them straight away and was told they they could not find why i received 2 and would have to investigate and get back to me. I then told her thats OK who do i send the storage invoices too and when she asked what did i mean, i told her the £50 a day storage fee for the storage of their products, i need to know who and where to send the invoices too and guess what she suddently found out the problem and said a courier would collect it the following day and for my trouble they would cancel the invoice for the first fax machine.
this was not the first problem i had with viking (no longer use them)

    Thanks for the help guys.
    mmm will sleep on it.
Yes i see your point, I'll leave it till the end of the week then probably call/email them.

Sounds like you didn't get the answer you wanted, and are putting off what you feel (know?) is the right thing to do.

I wouldnt want to send it back either, its a rare chance to get ahead for a change. But after a couple of days id send the email and hope they say keep it.

a lot of companies would weight up the inconvienience and costs of sending a courier to collect the item and restocking the item against the actual cost of the item to see if they will collect or tell you to keep it.

Makes you wonder why people ask for advice ...

    Person A: Should I do X or Y?
Person B: You should do X
Person C: You should do X
Person D: You should do X
Person A: Okay, I'll sleep on it.
  • I would keep it and sell it. The way I have always seen these things is, a lot of shops have signs up saying "please check your change, as mistakes cannot be rectified after you have left the shop", so the way I see it, the few times I have been given too much change, once I have left the shop. TOUGH.

My opinion/thinking applies here too. If they cannot organise themselves efficiently and effectively and actually read and print an order, deliver it etc. That is their fault for being incompetent!
  • I am surprised by some of the regulars suggesting it is unsolicited goods. It obviously is not unsolicited since they ordered an identical product the error was only in the quantity.

You need to keep the item safe and give them the opportunity to collect it. It's not yours OP so contact them. If you keep/sell (steal) it then hopefully karma will come back to teach you a lesson.
    Thinking critically since 1996....
  • They had this on one of the BBC consumer programmes with Dominic Littlewood, in terms of what you should do and what your rights are, and they quizzed Joe public, most people answered like the majority on this thread, about duty to send back and its stealing if you keep it etc..etc.

In actual fact she has every right to keep the extra printer, and sell it if required. This apparently becomes a unsolicited gift by the store/provider as only one was ordered. They are not entitled to ask for it back or anything else.

I would have slept very easily.......
  • The legal definition of unsolicited goods is
“unsolicited” means, in relation to goods sent to any person, that they are sent without any prior request made by him or on his behalf.

A request was made for these goods but the trader made a simple mistake when sending them, therefore they are not unsolicited.
