Mrs pb's just gettin her receipts together however she just noticed the rcpt's for items she bought in the US are missing, any guesses where they are.........

    Yup in the lost bag!
If you have CC statement showing spending in a store that is likely to sell what you lost, that's good enough.
The common law of business balance prohibits paying a little and getting a lot. If you deal with the lowest bidder, it is well to add something for the risk you run, and if you do that you will have enough to pay for something better.

I was waiting on their reply - they respond to things incredibly slowly. They have said they will give me £211, and I'm not really sure where to go from here. Chalking up £200 to experience is rather expensive. I'd still rather have my stuff though :-(

They have a maximum liabilty through the Warsaw convention. If you have super expensive or unusual items, you are expected (not just by BA) to have travel insurance to cover that fact. In order to increase the likelyhood of more of your claim to be paid, you need to provide receipts/evidence of purchase of the items you are claiming for, which will show not only that you do possess these things, but also when they were bought.
One of the reasons you may have been offered less, is wear and tear. Airlines are not obliged to replace new for old, but offer the current value of an item. You can therefore see for example that a dress that was £45 new, and is a year old, would not be reimbursed at £45, maybe more like £20. They will most likely have a depreciation list for various items, that says how much to deduct for each item for usual wear and tear. So unless you can prove the items you lost were pretty new, they will always, unfortunately, pay out less than the purchase price.

  • I guess other than the food that was in there, most items were on average 8 months-15 months old. I definately see where they are coming from with item depreciation, but unfortunately you can't usually buy half depreciated items to replace them :-(.

See the bottom line of post 4 ;)

OMG - Stoneman, thankfully I didn't read that lol, but the case arrived next day - bizarrely it was brought back via amsterdam even though there was a direct flight due the next day. Glad we got it.

You could look on ebay for replacements, which technically could be half depreciated, but i take your point. I think the logic is, that if its say 12 months old, how much longer would you have had it without having to replace it anyway- you will be getting part of the money you would be spending to replace anyway, just a bit early, IYSMIM.. (not that i'm saying the logic is right!).

You've avoided paying tax and now have lost out out on an insurance claim because you are spending untaxed cash. I can't say that I am very sympathetic.
