missing baggage on virgin flight

Folks.

On our recent flight back from NY virgin miss placed mrs pb's baggage, of course this situ could have been worse it could have been my bag, anyway 21 days rolls around tommorow and then the bag is officially lost.

So my question is this when a claim is made will virgin take into consideration the price to replace the goods or just the retail value minus any depreciation?

The reason I ask is the bag contained 4 pairs of levis and 2 new pairs of shoes which the replacement value in the uk is far more than was paid for them add to that some cigarillos which she had bought duty free, it could lead to a hefty loss to replace the items.

Im pretty sure I know the answer but would be interested in anyone previous experience of such issues

    What about the Ipad, SLR, Jimmy Choos and fifty inch 3D tv that you obviously had in there too???

    ...On a serious note I got about £100 from the airline who pretty much refused point blank to accept it was their fault and had to claim on my travel Insurance.

    Oddly she had two pandas in her bag, one of which was called wang wang!

    Think the thing shes most naffed off about, other than the shoes is her ghd's which were in there, odd never had this problem flying ryanair or easyjet!

    Ah but of course it wasn't Virgin that lost the bag, it was the handling agents at NY so don't know why you mention RA and EJ. There is usually something in their T&C's about how much they will pay, but I also think there is something in the international airline treaty about that as well. You will probably get more from you travel or contents insurance. Mind OH lost a £600 pair of boots in a delayed bag with Delta, we filled in the on line form and received a cheque within 6 weeks, even though their terms said that the max they would pay would be £400.
    Just be grateful you didn't fly from PHL, known as the lost baggage capital of the world.
    The common law of business balance prohibits paying a little and getting a lot. If you deal with the lowest bidder, it is well to add something for the risk you run, and if you do that you will have enough to pay for something better.

    Ok if it makes it more palateable for you "ive never had this problem with easyjet or ryanairs baggage handling agent" personaly i dont see it makes any difference i wasnt trying to say richard branson himself had lost her bag but a company working on behalf of virgin have lost our bag therefore as a contractor for virgin they are responsible!

    Maybe it is as well it was lost. You would have had problems at customs!

    The bag was put into the care of Virgin when it was placed on the scales at check in and from that point on whatever happened to it is the responsibility of Virgin. It doesn't matter who lost it, Virgin accepted it and they are liable.

    For all anyone knows, the problem may have arisen due to the check in staff not affixing the baggage tag securely in which case it would have been them that lost it.

    Unless there has been a change recently, the amount of compensation that airlines pay for lost luggage is determined by the Warsaw Convention, which gives amounts per kilogramme, and those amounts have never been updated since the time of the Convention (before the second world war). So anything you get from the airline (apart from a matter of pennies) will be the result of them being nice to you rather than a matter of obligation, and you should be looking at your insurance position.

    You would have to work out how much you are going to lose with you insurance due to excess and premium going up next year, so might be worth finding out what VS are going to offer.
    And the reason that you don't seem to have this problem with RA and EJ is because in general they fly to and from smaller airports, not massive international ones. This is the reason RA boast that they have the best lost luggage record of any major airline, and the fact that they incourage you not to have hold bags.
    BTW I was only being pedantic with the "who lost the bags" comment;)
