Parked cars don't usually get checked by ANPR, driven cars obv have the driver with them and the officers are in a position to stop the car.

It's not actually a breach of DP more the terms of the MIB database, there will be reasons when Police and DVLA can of course check if a parked car is insured but its not a routine or often used practice.

I was referring more to when you ring the Police to report this car, at that point the person taking details is not with the driver or heh so will not normally be able to check insurance and once established there is tax and no apparent obstruction will advise that its within its rights to be there or refer to the council etc.
