vodaphone help needed

The OP could write formally to Carphone Warehouse asking for proof of delivery.
If the delivery people cannot prove it too, then its theft, the contract would be null and void.
The only issue though is the time lag, both retailer and delivery company could say they do not keep records that far back due to data protection.

that was all sorted they gave me money back and 3 months free.it was there error.

I hope you do get this sorted, but my main concern is the fact that, whilst you were well aware, of the fact that there is a possibility, the phone, could have been delivered at the similar address, and yet you stil never tried to make early enquiries. Did carphone warehouse send you a delivery confirmation,even. ither by text or email?. And considering it was xmas, I bet if it was delivered at the similar address, they would have thought Santa sent it.

yeah i was a but stupid in leaving it a month,but and i am an honest enough person.id actually forgotten about it.but i never recieved an email or postal confirmation of any sort.

ill be contacting the below rep now with my information..
