vodaphone help needed

to cut a long story short.i had an 18 month contract with vodafone.which was due to run out around january this year.so i decided id like a new phone with lower monthly payment.i ordered from carphone warehouse.waited a month but never recieved the phone.i contacted carphone who got back to me saying that the item had beeen delivered to my address and they had a signature.i told them i hadnt signed for anything and no phone had been delievered to me.they said that they would contact the delivery service.they got back to me again saying that it had been delivered,but "Due to the time since the item was delivered
DHL are unable to investigate this matter further than this to give any
information".i have emails still that i have sent and recieved.they told me to contact police and report it as theft.why should i do that its down to the courier service and themselfs to sort out not me.by this time id been charged by vodafone for the contract.i filled out a question sheet online at ther site telling them about the situation.all i got from them was. "Christopher, I have reviewed your account and can confirm that you have two number on your account 0xxxx4486944 and 0xxxx223641. Even if you are not using your number you will be charge with the line rental. Your bill of £146 was charge for the line rental from 2nd Dec to 23 Feb for 07585223641 and from 1st Jan to 23rd Feb for 07824486944 on pro-rata basis, and your bill £139.84 is for two months". btw my name isnt even christopher,so dont know where they got that name from.they took that amount from my account also.i also told them to cancel it as i had not recieved the phone,and my other phones contract was up and didnt wont that one to continue.i never recieved another response from them.i wrote a letter to vodafone.explaining what had gone on.no response.i cancelled the direct debit from my bank which there was only 1 for vodafone.i had no contact from them then started to recieve bills for what should have been new phone.i thought must have been a mistake and ignored them.well im at here now where they have cancelled the account and sent to a collection agency "fpc" which i gather many have had experiances with.they phoned me "fpc".after they had sent me a letter and i told them i didnt wont to speak to them.so for an item i never recieved and have been ignored by vodafone i have a bill for £750.
i need to know what path to go down as there is no way im paying for an item i never recieved and reported not recieved,but have been ignored by carphonewarehouse and vodafone.

    Could be fraud but why did you not contact them back in January and not notice your huge increasing bill earlier?
    And where are the bills going - even if wrong name?
  • i did contact them back in january,well begining of february,when i got a bill. have emails to confirm this.problem was i was just ignored after initial emails.i also wrote a letter again ignored.ive made the effort of contacting both carphonewarehouse and vodafone.no response.

    Well I don't know what the exact facts are, you could be telling the truth or you might not (no offence).
    You might want to contact the vodafone reps on this forum as suggested here

    and see if they can help you find out what is happening (presumably there is some sort of fraud investigation going on).

    Sorry just to get this right, you placed an order with carphone warehouse and for the whole month, after placing the order, you never inquired, on its delivery?.
  • The posters issue is with Carphone Warehouse where the contract was taken out. All Vodafone were responsible for was providing the airtime on behalf of Carphone.

    Non delivery of the phone should have been raised with Carphone the first week after the order was placed and not left for a month.

    That's exactly what am saying why "if you did", wait for the whole month to enquire about the whereabouts of your very expensive phone, line, everything. I was off work two days, waiting for a delivery, and in the end had to drive some 30 miles to pick it up at the couriers depot. So I can't understand why you never enquired earlier enough?.
  • i work for a well known parcel service ,not DHL. They should be able to provide you with the details of who signed and what time, and where they left the package if not delivered to your address. Time is irrelevant when investigating this so dont be fobbed off by their bullsh#@. pursue it.
    ps most dhl workers i chat too are ok but even they told me some of them are dodgy characters.
  • yep i know its sounds daft that i took a month for me to enquire about.
    but it was xmas period so id forgotten about it.

    but i did report it to carphonewarehouse.who investigated it.they got back to me saying it had been delivered.

    i told them i hadnt recieved anything and could they trak it for me.

    again they got back to me saying it had been awhile since delivered and courier had a signature.

    what i usally do is leave a not if any parcels are due were to put it if nobody in.

    but no note was left.and it certainly wasnt signed by me nor anyone else in the house.of which there are only 2 other people.

    my only thought is that we do get mail for a same number house just different street name now and again of which i just pop back in post box.

    it may have been delivered there,theve opened it seen what it is and kept it.i carnt just stomp round and say have u had a parcel delivered for my address.highly unlikley there gunna say yes here ya go.
    especially since its a nice new phone.

    when i say street names are same
    for example

    southcroft way
    southcroft drive

    if you get what i mean.

    the street in question is like 5o yards away.but the streets all back onto one another.

    any ways i contacted both carphonewarehouse and vodafone with no results.so left it at that.
    stupidly i know,but i reported it not recieved what can i do.if there not bothered why should i be.

    basically i need to sort it as im not paying for something i didnt recieved and reported it.

    the phone is an htc google magic.
    they took the money 20th april its 5th may.still no service.
    i have no bill and theve never sent me one either.not with any details.
    i didnt sign anything cause i got it of internet.phones for u website.
    ive canceled the direct debit from my bank they arnt getting another penny from me.

    I am no expert and can be wrong, but that's how I see this:
    • Your deal was with CPW, they cannot prove that the order was delivered to you and it is their responsibility to sort everything out with Vodafone.
    • Send them a Letter Before Action demanding either to do the above or to pay you all the money you owe to Vodafone over 18 months.
    • Then take them to the Small Claims Court (online).

    In their turn CPW can sue the delivery company.
