goods not arrived, i am seller

sorry if this question has been answered somewhere else, i sold an item of footwear recently and posted, got proof, 8 days later not arrived, buyer contacted me and i responded by saying that i have proof and can forward it to them, royal mail wont look at a claim before 15 working days which is 22nd,they responded by saying ok told me to keep the receipt and i could persue the claim after that date has passed. They now have opened a case against me wanted a full refund. While i can understand that they are upset that their item didn't arrive i have proof that i posted it . I have responded to the case and have also said that i willl forward the proof to them and they can deal with it themselves as the fault is not mine. Are ebay likely to give them their money back as that seems unfair i am a genuine honest seller just trying to raise some funds by getting rid of stuff. TIA

    It's the seller who has the contract with RM, so it's you will have to make a claim. You can't though expect the buyer to wait for you to be able to claim from RM.
    Yes the buyer will win the dispute.
    The moment that a seller says that they will forward the COP for the buyer to claim, is when most buyers will open a dispute.
    How did you post, was it 1st or 2nd? If 2nd then it could just be late.
    It may be worth you finding the number of the buyers local delivery office & giving them a call to see if it's there waiting to be collected by the buyer.
  • OP, the fault is not your buyers.

    You as seller should refund them and take up the non delivery issue yourself with the PO using your POP.

    The dispute will give the same outcome i.e. a full refund but be a mark on your selling account against you.

    Really, if you can't prove delivery, the buyer will win anyway, you might as well not drag things out and refund now.

    The fault is with RM but their claim is with you since you are responsible for items lost in the post. If they have opened a dispute you will lose and have to refund them so there is no point fobbing them off any longer.

    It may seem unfair but you carry the risk as the seller in this case; you may be "honest" but you can claim from RM for the loss. Buyers should not have to go to the time or expense of claiming - that's your job.

    There are just so many things wrong there.

    You need to read some of the threads on here by buyers who have parted with money, not got their goods, then the buyer says wait 15 working days and you can claim yourself.

    Then you need to read up on eBay rules and learn to sell.
  • Ok fair enough i wasn't really aware of any of that as i only sell bits from time to time, i was going to persue the claim as soon as the time was up but no point doing it before hand surely. They were sent 2nd class and are now 12 days since posting, she has been to her local sorting office to see if they are sat there but apparently not. Do you think i will have a problem getting money out of RM.
  • There is one important thing that you should remember in cases like this.

    As you won't be able to prove delivery then it is guaranteed that the buyer will be refunded in full (from your paypal account) and the buyer will get this refund with or without your help.

    You as the seller however may well need the help of your buyer in order to claim compensation from Royal Mail, and if you drag out the refund process too long then they may not be willing to assist with your claim.

    When you claim is not relevant to the sale, other then has been said, you May need help from the buyer as RM sometimes send them a form to confirm the item hasn't arrived.

    Refund, then think about your claim. The form is online. Fill out the form and send a copy of the eBay sale page and your proof of posting.
