Genuine ugg boots- ripped in 3 weeks

I purchased some short style real ugg boots from a shop in Gunwarf Quays in Portsmouth. I have had the boots for 3 weeks now. and have only just noticed the seam at the back of the boot has come away a tad. I am now scared to wear them just because I don't want to make it worse. I have worn the boots about 3 times and obviously you can tell. But there in perfect condition and the tear shows that It is the boots not my fault as its basically come off the seam abit. Im deeply upset as there cost £140! What rights do I have, I am going to ring the store today and want to know what big words I can say to help me with my case really. I just want some reliable boots for the amount I have paid! I also live on the Isle of Wight, so have to get a boat to the shop which I want to know for sure before I travel, I have any rights to get them replaced as it is in no way my fault! Somebody help! Im only 19 and nothing ever happened like this before, thanks in advance!

Using "big" words isn't really the way to begin!!
Explain they issue politely, friendly and factually, see what their resolution is. They may surprise you.
If they are defective (ie not damaged by you or through wear and tear) they will offer a repair, replacement or refund. Its their job to prove the fault is not inherent within the first 6 months under Sales of Goods Act.0 -

I know the place you mean (I'm a local girl) and I'm sure you've bought the real deal. As such I'm also sure you'll have no problems returning the boots for a replacement, repair or refund. Unfortunately you're going to have to get the ferry and go back to the shop. Just explain that you bought them three weeks ago (take the receipt or proof of purchase, e.g. bank statement) and that the seam's split. I'm sure it will be fine but stand your ground. It's worth noting that the Sale of Goods Act stipulates that faults which develop in the first six months are deemed inherent, i.e. there from manufacture, and you are not obliged to prove that you've not damaged them yourself. If they try to say it's your fault, point this out.

In this case it's easy to see a fault with the stitching on the seam. Fair enough.
The reason I say this is because the people that go in quoting this, that and the other generally don't as good as a response to those that merely go in to discuss the problems and give the shop the opportunity to offer a remedy.
If though you don't get the result your looking for, you can then change paces and insist they honour their legal obligations and reminding them of your rights.
But you generally get what you pay for, with these shoes being high in value, good service is key in protecting the brand name and continuing to sell top end products. So they may well bend over backwards to keep you happy. And if you cheekily ask for some form of goodwill gesture (worth doing if the sales assistant seems to be in a good mood) they are more likely to offer something if your friendly
I remember I was in staples once when a student walked in with a laptop. She approached the member of staff, her opening line was "I bought this from you in [month] (it was about 9 months old) and it is faulty. Under the sales of goods act you must refund me in full!", not only was this rude, but also incorrect. The member of staff sent her packaging "contact the manufacturer". I can't help but feel if she had a different approach she would have got a much better response, as their service is usually pretty spot on! Thats story time over, time to get back to work

Yeah, Its called Bootique, and only stock UGG really so Im sure there the real deal which is goodyeah think im going to have to on saturday, which is a bit of a pain seeing as It entirely not my fault, but will be worth it! I have rang them this morning, and she advised me that they have about 1 in 100 that gets returned, so they have seen this before. But she also said that I am going to have to get the manager to look at them to see weather or not they think its my fault or not. Didnt really like the sound of that. But fingers crossed they will see its not! :T
