Parking eye - Hartshead Moor

Hi there.

I'm sure there are many PArking Eye threads on here but none seem to deal with this.

I've received a ticket for parking for four hours while I was working at Hartshead Moor service station on the M62.

It's a Parking Eye bill.

Do I pay the fine? Or is it unenforceable?

    Yes, unfortunately Welcome Break have being taken in by Parking Eye and they are installing camera's at many of their service stations.

    Please e-mail [EMAIL="Paul%20Comer"]paul.comer@welcomebreak.co.uk[/EMAIL] (he is in charge of parking at Welcome Break) and ask him why they are allowing a bunch of extortionist to scam their customers out of their hard earned money?

    I am sure he will just ignore you, like he did with me!

    I had a long email discussion with Paul Comer of Welcome Break, I don't know which business school he went too, but I don't think he got past the induction stage. Some of his reasoning was unbelievable, I remember one of his quotes very well, "you have a moral and legal obligation to inform parking spy of the drivers details"
    Funnily enough after I sent them and parking spy a letter saying put up or shut up, both shut up.
    I know he is well aware of Parking spy's actions and doesn't give a toss!

    I never use welcome break now, not that I am worried about speculative invoices, but I would rather give someone who appreciates my business my hard earned.

    Also the reason the only advice worth following is to ignore them!

    It's very dangerous for him to go spouting that kind of nonsense. Moral issues are almost a matter of opinion but to state in black and white that you have a LEGAL responsibility to tell them of the driver is, as you know, completely incorrect. Which is the polite way of saying it's a lie.

    You don't at the moment anyway.....If this so called 'Freedom Bill' makes its way into the world that may change. Not that it would change the fact that it would be an unlawful penalty still.

    HE could be looking down the barrel of legal action if he's not careful.

    The email I received his email is in red. I broke it up with further questions. His reply after this was take it up with Parking Spy.

    Thank you for your email below regarding the Parking Charge Notice issued to you from Parking Eye.
    I have looked at the issues below in detail and would like the opportunity to respond to you.
    The letter from Parking Eye is a Parking Charge Notice sent out to yourself because the vehicle in question stayed longer than the 2 hours permitted at the Welcome Break site. There are numerous signs across the car parks detailing the parking tariffs and the charges that will be due if payment for parking is not received. The letter is not to be confused with a Penalty Charge Notice issued by the Police and local authorities.

    I understand there are signs around the car park however since I was not the driver or even with the vehicle I could not agree to the terms and conditions displayed. I do not confuse the ticket which is issued by a police officer or a local authority with the "invoice" Parking eye sent me. However can you then explain why they have imitated the format of a official ticket which can only be done to try and intimidate people into paying.
    The letter has been sent to you as you are the registered owner of the vehicle. The BPO code of practice shows in P9.4 It is the drivers obligation to pay the parking ticket. If you receive information from the keeper which identifies the driver, and the driver is someone else, you have an extra 21 days after receiving the information to serve the parking ticket by post to the driver.
    I assume you mean BPA, if so Can you tell me under which statute I have to abide by any code of practice of the BPA. Also they have been informed I was not the driver.
    Looking at this I feel that the moral and lawful responsible for your vehicle rests with yourself unless you notify Parking Eye of the driver involved?
    Can you point me to any legal requirement that states I must inform a private company who was driving at the time this incident occurred. My responsibility is limited to that set out in the road traffic act. To which I do fully adhere. If this was an official PCN then yes I would be responsible for any penalties due as the registered keeper if I did not disclose the driver.
    The charge of £60 as the initial charge is fully in line with the BPO code of practice P10.6 and is clearly displayed on parking signage in the car park areas.
    Their charge of £60 may well be in line with BPA code of practice. However I suggest Parking Eye take this matter up with the person who entered into any contract they believe existed?
    Due to the facts above I am not sure what offences Parking Eye have seemed to have committed.

    Try demanding money with menaces, I am not responsible to Parking Eye yet they send me a PCN for £60. I sent them a letter stating I was not responsible and stating I was not obliged to inform them of the driver at the time. Today I receive a letter stating my appeal has been unsuccessful. I did not appeal I just informed them to take it up with the person who was driving at the time. I will be writing to Parking eye immediately to inform them that I will not be paying I will not inform them who was driving the vehicle and if they wish to take it further I will enjoy my day in court.
    I must also say I was disappointed in your response, However I would be interested in your comments on the points I have highlighted.

    Another point that needs to be raised with the operators of these service areas is that parking time restrictions go against the Government's "Tiredness Kills" campaign.

    I looked into this once and in the lease the government give these companies it stipulates that they must offer 2 hours free parking.

    Should in my opinion be at least 4 hours.
