Tenant insists they have paid rent - they haven't

Really struggling with some new tenants that moved in on 1st of September.

There are four on a joint AST. Only 3/4 of the rent has been received. Each individual is insisting that they have paid. Two transfers came through with names (so I know which individuals they are), one was anonymous and one hasn't paid.

Each of them are insisting they have paid and I don't know what to do. I have reminded that they are 'jointly and severally liable' etc and next step is the guarantors.

However I really want to pin down which one hasn't paid, so that I can chase their guarantor in the first instance and try and work out what the problem is.

They are even accusing me of trying to get them to 'overpay' and 'conning' them what a joke

    Can your bank give you any idea where the "anonymous" payment came from? They wouldn't be able to tell you account details, but perhaps an account name or the source branch?

    When you did the initial credit checks, did you take bank details off each one? This would help you identify which one has paid you.

    All they will say that it is anonymous as it is an internal payment from another 'halifax account.' One of the tenants has a halifax account the other Clydesdale so I'm pretty sure which one hasn't paid.

    The one I suspect hasn't paid though is insistent that she has. Actually they are all insistent that they have.

    I did do credit checks and take bank details which is why I'm fairly confident I know which hasn't paid but she is so insistent.

    The doubt I have is due to the 'anonymous' payment so I've got it down to two, but I cannot be 100% sure.

  • Ask them to provide a copy/screenshot of their bank statement (they can blank out other transactions if necessary), surely?

    Maybe they transferred it online and it hasn't gone through yet. Maybe it doesn't do instant payments and takes 3-4 working days to come through.

    I would ask them all for proof of payment (bank statement print outs, or even if they show you their transaction on the computer)

    Maybe they paid it into a different account, maybe had a wrong digit somewhere. I would ask to see the details they paid to.

    It most likely is something like this.

    There may be an error here, perhaps she has your account details wrong. I'd be asking her to confirm exactly what she did to pay and then if that's correct suggest she contacts her bank to query what happened. You can each show the other you bank statements to show if the money departed and didn't arrive. If she doesn't co-operate it'll tell you if it wasn't an innocent error.

    Stop assuming the worst - this is the first payment so could easily go wrong.

    One digit wrong on sortcode/account number and the payment will go astray. Tenant genuinely believes it's gone but you don't get it.
    Or payment may be slow - BACS? 3-4 working days?

    Be friendly/understanding rather than threatening at this stage as it's probobly an innocent mistake.

    Ask for date sent.
    Copy of transfer / statement (blank out other transactions)
    Confirmation of destination sort/account (NOT just where she thinks it went, but where the bank actually sent it!)

    Once this 4th lost payment is found you'll find future payments go through like clockwork.

    It is not uncommon for tenants to lie, but you need to exhaust the show and tell options before assuming the worst.

    you can get copies of the paying in slips which were signed by the payer-in if it was paid in cash - this will contain a signature. Halifax takes days to transfer money.

    As usual these are wise words from G_M.

    An other possible error could lie in how she or her bank set up the timings on a standing order to make the payment.
