Phone Missold?

I bought a blackberry curve 9300 yesterday from Phones4U on PAYG, to put my contract Vodafone sim into. When buying it I asked the man helping three times whether or not it would cost me to use blackberry services because I had heard somewhere that it did. He reassured me each time it would not cost me extra as I already have unlimited internet factored in on my bill. He did however tell me, in order to set up blackberry services I needed to ring my service provider and tell them to add it.
So this morning, I called them and was told I would be charged £5 a month for the privilege. Is this classed as being misselling? Because I only bought a new Blackberry because I have been using a phone with internet for a year, and paying for internet on my contract and it seemed like a waste. I didn't want to pay extra!

Ontop of that Blackberry services still will not work, although this could be my error as me and technology don't get on... I want to return the phone but know as its been used for a day I wouldn't have a leg to stand on but on the principle of it I don't want to be paying the extra £5 a month. Any advice? Thanks xx

    Personally I don't think you have a leg to stand on or was misold anything, simply that you have changed your mind from the deal, you did not have to sign up there and then, you could have taken time out to investigate your choice further, looks like you have just under 24 months to go go :o

    This morning you could have easily returned the phone after calling your network. Why have not you?
    Now you can try returning it if you have not used the PAYG card. Do a factory reset to tidy up.
    Otherwise is it possible to disable the BB services and keep using the phone without them?

    I believe it is Grumbler - When I was looking into getting a sim free BB (I know, I know, I've already hung my head in shame - jk ;)) I did a little bit of homework on the topic of the blackberry tax (not very much though, an evening's googling at most).

    The way I understand it all you really get is push email, the ability to run multiple inboxes simultaneously, & a sort of "pre-downloader" for email attachments, that sits between your phone & the wider internet.

    If you already have a data allowance as part of your tariff then the guy behind the counter was telling the truth afaik, because despite common misunderstanding, BiS does not equate to internet access, despite it being in just about every network's benefit for people to think so. :)


    *EDIT* Actually, I'm being a bit horrible to blackberries there - I'd totally get a 2nd hand BB 8800, 8820 or something to keep in the bike as a backup phone.

  • Wow, I wanted help, not sarcasm. If your going to be sarcastic at least read my post correctly. I thought this forums main rule was to be nice to people?

    I didn't take the phone back this morning because my daughter was ill.. childs health over phone.
    The DEAL was a sim free blackberry to put my existing sim card in in which I am 14 months into a 24 month contract. Nothing to do with the blackberry I bought yesterday. I was misled to believe that I would not have to pay anything extra ontop of my current contract (£35 p/m) in order to use blackberry services. Blackberry services is not the internet, it includes BBM, apps, etc which I cannot use without it. Therefore the question I asked, and repeatably may I add, was right.
    And yes, I can disable blackberry services and use the phone without, but in such a case I may as well have kept using my cheap phone to just call & text.

    The forum rules are to be nice but also answers do not have to be wrapped in cotton wool, but it is not fair to blame the sales person when it was not essential to have the handset yesterday, you could try what grumbler suggests , at least you are not tied into a lenghty contract that would have been worse, is the handset saleable?
    As people lose their handsets and not insured and looking for a replacement.

I can't understand how the salesman is not to blame and I am when I asked the person you would assume would know. I'm not looking to go into the store all guns blazing, I just want to know if in *MY* situation, a refund would be possible after a days use. Not in the situation whereby I was tied into a contract, not in the situation where I simply disable blackberry services and use the phone as a basic calling/texting phone but in the situation that I described.

    Yes the handset is saleable it has hardly been used and is in perfect nick and has everything with it still however selling at a loss seems unfair when I was led to believe something that wasn't infact true.
    No, it was not essential to have the handset today as I haven't been using it, but as a single parent somehow my child's welfare comes before a mobile phone.

    I was wrong. You wouldn't be able to return even unused handset:
    Phones4u does not operate a 14 day return period on SIM Free phones.
    If it's still looks like unopened, you can try on Monday to accuse them of misselling and to return it, but this will not be easy.

    Many of us are parents, but there is lots to life other than parenting, no need to go into the store all guns blazing, the sales rep simply is fetching a handset from the store and doing the necessary on the till, the purchaser also has an obligation to carry out their own homework before making a purchase. Who knows the store may have a generous returns policy, but going in guns blazing is likely to have you leaving even more dissapointed. :(
