What refund am I entitled to?

I bought a pair of boots the other day which were described as being used but in perfect condition. They have arrived this morning and there are scuffs all over the heels, the faux leather is peeling off around the tops and down the backs, and the fronts are dented. The soles are worn so that the pattern is unrecognisable in places. I paid £3.70 for them and £3.35 postage. I have emailed the seller explaining that I am not happy with them, and she has offered to send me a payment of £1 as a gift, and wants to know if I'm happy with that decision. Well of course I'm not! I replied stating that the rips/scuffs were extensive and definitely not in keeping with perfect condition. I also stated that if they had been described correctly I would not have bid on them.

I would like to ask what sort of refund I am entitled to. Is it just the purchase price, or postage aswell?

    Have you told the buyer you don't want them?

    At the end of the day, if you return them via a dispute (which should be your last resort) then you will be refunded your original payment of item plus postage. You will have to pay for the item to be returned though.

    You're onto a loser will this one.

    You would have to send the boots back, tracked, to be sure to win a dispute.
    That would give you a refund of what you paid, + your initial postage costs.
    You'd be down the return costs though.

    So, at best if the seller won't play fair -

    Ideally, the full refund of £7.05 would be good, but realistically anything that takes you up to the difference when you take off the return postage costs.
    Say the £3.70 and you chuck the boots.

    You could try a dispute in ebay, sometimes they refund without the need to return in low value cases like this.

    Thanks. Wow it's a bit rubbish if you end up being out of pocket for something which was the sellers fault. Will see what she responds with but I can see a big fat neg coming her way.

    Ok she says she disagrees about the condition of the boots and was offering £1 as a goodwill gesture. She says the boots were £70 new (don't know if I believe that, they're not even real leather). She says there is nothing more she can do and she is not prepared to give me the boots. She says if I pay for return postage then she will refund me the £3.70. That would still leave me £6.70 out of pocket for paying 2 lots of postage for something which wasn't my fault! Do I take it to dispute?

  • Yes, dispute. If you do it in Ebay, it may be a bit lengthy, but if you state on the dispute that you will be out of pocket and it isnt your fault, ebay MAY give a no fault refund or offer you a voucher for the returns postage. They don't have to, so don't get your hopes up!

    Make sure you reflect your feelings in feedback, but only when you have your refund and make no policy breaches.

    The problem with a dispute is that you'll have to send back tracked at your own cost, which would get you a £7.05 refund. I'd still do it, making it clear in the dispute that you want return postage paying too, then leave 1* for all categories, and a neg. The seller is clearly asking for it!

    If you can pack the up for under 1 kilo it would cost £3.30 including VAT tracked (for disputes you don't need to worry about a sig)

    Thanks for your replies, I have taken it to dispute. There wasn't a lot of space to write what you want the outcome to be though :/

    Oh, and she will be getting a neg and 1* for everything. Do I have to wait until the dispute is resolved before I leave feedback?
