Help! Letter from debt agency but not my debt!

    I would have had some fun with this if it was me....dan, start playing games with the idiots and then put a complaint in about the buffoons.
    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    You need to make a claim against wonga.com in the County Court for the severe distress and damage to your health that wonga.com has caused.

    In your claim, account for every minute of your time that has been wasted in dealing with the disgraceful negligence of this rogue lender.

    Record every letter, every email, and every phone call that you have made in relation to your unfortunate but blameless involvement with this wretched company.

    You should also report wonga.com to the Financial Services Ombudsman for this malpractice.

    I emailed Wonga saying this is not good enough (in response to the email I put in my previous post) and you have dealt with this matter in an appalling way. I got a reply back quite quickly which surprised me. They said they have got in contact again with the debt company and are 'currently waiting a response'. This was sent to me on the 6th December. And so I left it.

    Today I received yet another letter from the Gothia group. This time a Litigation Notice. Basically saying I have not resolved the matter and the payment is overdue and threatening me that the sum will increase if legal action is taken.

    They list Court Fees, Solicitors Costs etc.. ....
    ......'we will assume that any further delay from you in resolving this matter can only mean that you are deliberately avoiding your obligation to clear this matter and will take steps accordingly...'

    My question is:

    We have established that I am not the owner of this debt from Wonga BUT can they(the debt company) charge me these legal fees for ''not resolving this matter''?

    I have had no response to any of the emails sent to all the addresses on these debt letters - Gothia/Red Castle/RLS

    I have yet to send any letters/templates off that you kind people have mentioned because I have been too busy to deal with all this but will definitely look into making complaints etc. soon.

    This evening I sent another email to Wonga. I stated I wanted this matter escalated to a complaint (as I requested in my last email, but was ignored) and also that they get it sorted pronto!

    I await a response.........

    The debt company have given me till the 25th December to make contact/payment in full/and to stop these court/solicitors fees etc..

    YOU DON'T OWE THEM ANYTHING INCLUDING ANY CHARGES THAT THEY ADD. so try and relax. the stupid dca think that you ripe for plucking so its time to tell them to get stuffed. seriously write and tell them that unless they confirm that they have made an error in 7 days that you will open a complaint with the oft. send it recorded deliverly. on the 8 th day write to the oft and include copies of wongas letters. include both dca and wonga in the complaint. so wonga will need a letter to. don't play the victim bite back hard. after you have sent the letters forget all about it until after christmas.

    I've read the thread from start to finish, at if you are under stress, its because you have not headed the advice you were given on this forum.

    There is a simple "prove it" letter you can send to the collection agency, after which they are breaking the law by contacting you unless they can come back with solid evidence to support their pursuit.

    Calling and moaning on the phone will not sort your problem out, there are procedures in place by the OFT to protect the consumer, you should follow them.

    here is a copy of what you need to send
    You have contacted me regarding the account with the above reference number wich you claim is owed by me.

    I would point out that I have no knowledge of any such debt owed to Wonga for £XXXX

    I am familiar with the 'Office of Fair Trading Debt Collection Guidance' which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

    I would also point out that the OFT say under the guidance, that it is unfair to persue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

    Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

    I would ask that no further contact be made concerning the above acount unless you can provide evidence as to my liability for the debt in question and I expressly request that all future correspondance is by email or letter only.

    I await you written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the Trading Standards department and consider informing the OFT of your actions.
