    i wouldn't think so, my mum used to claim family allowance for my nephew (her grandson) because he lived with her.

    No.
    Grandparents can legally claim for the child related benefits.
    I made a mistake once, believeing people on the internet were my virtual friends. It won't be a mistake that I make again!

    Isn't that only if the grandparents have the care of the child? As the mother was living in the household, the child benefit should be in her name.

    future plans need to be made, hopefully when she gets her child back, you can be sure the grandparents are going to try to get full custody of the baby...

    It depends how they have worked it as family unit. Granny and grandad can claim CB and CTC for the baby and the mother win, win situation. If the child (mother) claimed CB in her own right then daddy and step mummy would loses her CB and CTC. * I think*

    This is a good point. Please keep us updated and I hope that she gets her baby back and this all works out for her. Good luck with it all :)
  • Sorry for the delay in replying and keeping you up to date on this situation...She eventually got her baby back, her dad and stepmam told social services that she was a drug user (she wont even take paracetamol) they did spot tests and as expected she was totally clear. They are stilll fighting but as they where told 'on the quiet' that as they cannot adopt due to his drinking and police record if she allowed them to bring the baby up he would be a ward of court. I dont think she will ever forgive her dad and she and baby are now happy living at her mums. Have told them about this forum and how helpful it is in all sorts of problems, MSE has even more fans.
