I have difficulty understanding this position, when my children were born they became wanted members of our household, this is their home and I believe they have equal rights with everyone else who lives here. I don;t believe that gives any of us the freedom to infringe on other peoples rights, hence asking what is reasonable.

I actually have difficulty understandig this position. Theya re your kids not lodgers! So your kids have rights, but unlike a lodger, you are their parent and role model.

I think its nice you are asking for advice so to see it from another perspective.

I hope you work it out for everyone.
    Nice to save.

You could be right, as I don't think of it as her having to follow rules, but all of us coming up with a working compromise. This is her home too and I wouldn't expect her to 'move on' until she wants to. I am not happy about her smoking but she has a right to make her own choices. None of us want those choices to negatively impact on others though.

You should bear in mind that you could be in a weak position if the neighbour complains to the LL again. The LL might reach the conclusion that it would be less hassle for him if you were no longer his T.

You could then easily find yourselves on the wrong end of a s.21 notice (from the LL) of intention to possess the property, with potentially a duff reference when you do eventually leave.

S21 notice yes, duff reference: not if LL is smart (why cause it to be difficult for T to leave? As if it is too difficult they may decide to hold out for an eviction process surely LL doesn't want that?)

my son smokes outside and if he has friends over they are not aloud outside together only 1 at a time and this is after 10 and we live in a semi

noise carries and more than likely if other neighbours have tvs on at 11 they might not be able to hear it. my hubbie goes to bed at 9 as he is up so early and i have 2 small children in bed before 8.30 so i would be a bit peeved as well
  • As an aside, the properties have an old ducting heating system which is no longer in use, but in my bathroom which is completely enclosed within the building I can often smell very heavy cigarette smoke (it's not my DD, it's there when I'm home alone :) I know the neighbour to one side of me is a very heavy smoker and suspect it comes from his property, it's irritating but one of the drawbacks of communal living, but having read on another thread about 'smoke tests' is this something I should have further investigation into for fire safety?

Not sure about the fire safety aspect, but if the smell bothers you try covering the vent with a plastic bag fixed with tape. If this is successfull remove it and fit a more attractive and permanent cover.
  • You clearly sound like your not very conscientious or good neighbours to have really and you dont seem to have enough rules for your children

I had a lovely neighbour downstairs...but he loved to smoke at night just outside his patio door right below my bedroom window...and the smell was extremely annoying. Smoke really carries - I had to shut the window whenever he was out there for his last fag before bedtime.

I am sympathetic with your neighbour

This is such an old thread - I would suppose the issues have been resolved now one way or another. Why has it been resurrected?

She has the right to smoke.

Your neighbour has the right to open his windows and not have smoke come in.

    Therefore, she should smoke elsewhere.

    Simple.
