One of the two directors of APS is a barrister. He and his fellow director are, puzzlingly, also trustees of a prominent charity that one would not normally associate with the typical demographic of PPC World. That being said there is a process-serving side to work these two are involved in.

This is far from straightforward as it involves the charity which I think it would be unwise to identify at this stage as it genuinely does good work, but work that needs to be done behind the scenes - for very obvious reasons when it becomes apparent what they deal with - and for that reason I will not name it here and do not think that it should be.

By the by, this is not the first case that APS have issued proceedings in - and at a very early stage. I recall reading of a case in the last couple of months but despite searching I'm unable to trace it.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

Neither of which were able to come back and elaborate on the success or failure of the case. I lean toward success of the driver as they did not come back, op has not posted since on anything. Maybe we could draw a conclusion from this.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
  • Pity the OP has not been onto pepipoo to get a defence as she was to do so yesterday. I wonder how she got on.

I think the OP has everything to play for, indeed from what has been described sounds as though it isn't a formal court notification but a scam. Is there a legitimate court stamp on the claim form? If so, then respond. Otherwise, when checking with the court ask if the details are genuine, and if not, just continue to ignore. As has already been pointed out, they have to identify the driver, not assume it was the Registered Keeper - and stating that an unread sign equates to consent to the terms and conditions imposed has been thrown out countless times, expecially if they are as small as you describe.

they say its real, see post 9 but have not come back for input. Had they not queried this in June/July I would have said its a try on by the PPC.

Still no post on Pepipoo. OP if you need help I would be asking for it. You may need more then I was not the driver defence!
  • Thanks all, just back from 2 week holiday so frantically busy catching up - I am emailing AlexisV privately as suggested above, and I will pursue the Pepipoo information tomorrow/over the weekend. I will also keep everyone on this thread informed as to the process and outcome! (BTW, we took on Nationwide Building Society re unfair interest hikes and won earlier this year - see other threads posted - so i don't give in easily!) Thanks again, Linda. (BTW what does OP stand for please?)
