    I have been advised to continue the fight. The SAR will give me the same details that they have made their rejection on. I want proof that I ticked the box, because I do not believe I did, it was pre-ticked and then I will be continue via the FOS.
  • ,Have a secured loan with Black Horse for a ten year period. I started my PPI claim against Black Horse in Nov 2010, had a reply stating the court case pending etc etc. Contacted the FOS and they mixed up the paperwork with another claim, then the member of staff went off long term sick. Got a phone call from another member of the FOS team and gave him a quick update re my PPI claim. Told him that I had claimed against the PPI once in the past. He said that the chances of having a sucessful claim were slight. Got a letter from Black Horse telling me the court case had been resolved and I would receive their answer re my claim before 31st August 2011. Well, yesterday I got a reply saying that they will settle my claim and to sign the enclosed letter and return it.The letter does not state how much they are refunding but does state that 8% interest will be added. My question is should I sign this agreement to the refund? I phoned Black Horse today to see if they could tell me the amount of the refund but they can't do anything until they receive the signed agreement. What should I do?

    i have my credit aggrement and it is a computerrised pre-ticked boxi have not ticked it personally! im off to the FOS but before i do im rejecting their rejection and write them back giving them 14 days to respond see if that changes there minds! good luck

    I have sent off a SAR letter so that they have to send me all information they hold on two accounts I have with them. I have also mentioned that I do intend on going to the FOS as I continue to believe that I was mis-sold, if they wish to consider I have given them 14 days, if I hear no further I will definately be going to the FOS. It is takes a year, I don't really care, I just want back what is mine and it will only cost them more aswell as they will be fined £500 plus all that extra interest.

    They have sent me what appears to be screenshots of my application from 2001 showing a screen with two options for payment protection - one has a radio button and the words yes I would like to take protection, the other option is a radio button with the words no I dont want protection (along those lines anyway) however neither option is selected. Are they saying that I would have selected Yes myself in order for the PPI to have been taken?? If so what are my options now??

    Remember that having PPI is not wrong. It was how it was sold to you that matters. If you selected it yourself then you cannot complain it was mis-sold.

  • I had a rejection letter back from Egg as well. I applied back in Dec 1999. I have done the SAR bit and logged a complaint based on the fact that it was a pre ticked box. they sent me screen prints of virtually everything I have ever done during the period of time I have had my CC. The one missing bit is my application screen print. There must be someone really organised out there who printed off that screen and kept a copy!! That aside the FOS must look at the point raised here where they pay out on some claims and reject others even though the evidence and reasons are the same. Are Egg just stupid or do they really think that we will all just lay down and take what they throw at us!!

    I had a letter from Egg a couple of days ago saying that they have passed my complaint to their customer relations dept and will get back to me with a decision by December. This came 2 weeks after I sent them my complaint form. My complaint was the same as the above, the pre ticked box and no opt out option plus there was no cooling off period advice given to me. Basically at the time I was given/under the impression that the PPI was compulsory :mad: I applied for the loan via the internet.

    I'm expecting to go home to a rejection letter now :(:(:(
