EGG - Rejection What Now!!!

Got a reply back from Egg - Card Card to say that they are not paying me out and my complaint has been rejected! :mad:

They say i can take it to the FOS, should i go down that route!

My complaint for mis-selling was that it was a pre-ticked box for ppi payments and that it had to be unticked if you did not require it, it was such a long time ago! i feel so disappointed and a bit deflated!

Was hoping that i would be one of the sucessfull ones!

Advice really should i take it to the FOS now comments appreciated!

    Sorry about the rejection.

    Can you remember how this was sold to you?
    Such as online, or on the phone etc?

    If online, it may have been a case that it was already pre-ticked and if you did not require this then to untick (to opt out of it), but its also known that the application would not allow to go any further if the ppi was not ticked for.

    I would then if they have not give you the opportunity complain to the FOS, if they have said about giving any further information you can write back and enclose this and ask them to reconsider, or take a chance and ask anyway (with why you do not agree with their decision) with further information you may have and ask them to reconsider by 14 days, if then you hear no more or they do not change the decision then complain to the FOS.

    It's up to you, sometimes it known for businesses to change the final decision but you cannot guarantee on that.
    So therefore you will have 6 months as from the date on the final decision to complain to the FOS.

    Hi Lindsay, I got my PPI upheld from EGG for exactly the same reason. I had to tick to say that I would take out the PPI otherwise I couldnt carry on with the application for the CC. I had a pre existing medical condition so it was worthless to me. I'm surprised that they have turned you down, especially as I got my reply and cheque within 2 weeks of sending it!

    I would definately try again :o

    Do you have evidence of that?

    If you do then you have a strong case as the FOS dont like that. If you don't then are you sure that was the case? (moosetastic posted above saying they had to tick the box. you are saying you had to untick - so conflct in information there)

    Hi thanks for your reply i applied for the card online and it was a pre-ticked box for ppi and i had to opt out rather than opt in! they have said its their final response and i can take it to the FOS not sure what to do now, my brother had the same reasons and sent his claim in after mine and got a cheque 2 days ago! it just is annoying because it was the same reasons as him and ive got nothing! think they are just rejecting one and upholding another! not fair!!!

    i dont have evidence to say that it was a pre-ticked box as it was online how can i prove that! all i remember was that the box was pre-ticked for ppi and then you had to untick it not to get the cover!

    May I ask, how long ago you taken this out? (Year)?
    If within the last 6 years they will still hold data of this account, and you can optionaly request for all your data, for a cost of £10 cheque or postal order, they have 40 calendar days to comply.
    You do not have to do this, but there maybe useful information enclosed.

    It is possible that they changed their systems between one application and the other. If so, particularly if they have retained records of it, then the outcome would be correct.

    It is also possible that you went online and did not apply initially and then went back. If, in the meantime, the systems had changed, the audit trail would show the system change but your browser may have presented you with a copy of the old screen from your computer's cache.

    That would mean you were correct in saying what you saw was pre-ticked but the lender would also be correct in saying it no longer operated on that basis at the time. You would probably lose in such circumstances because there is no way to prove to FOS that you had a different screen to the one that the lender had posted at the time and, even if you could, the lender would have a valid argument that it cannot be held responsible for you using an obsolete means of application.

    i did a sar request and got a full copy of the agreement, but it has ppi ticked and the agreement is ticked as a sign of authorisation i took this card out in 2004 not sure what to do!

    I have been writing on the other thread today regarding my Egg CC complaint being rejected today (Discussion thread). I am off to the post office now with my SAR letter to request full details of my application etc., because I applied in 2001 when I was a young mum and only worked a few hours per week. I did not request PPI it was a pre-ticked box and I am not accepting their excuse. I personally think that quite a few people have got these letters, mainly hoping that people will give up but I certainly am not. I think they are just trying to gain more time (by replying by 31st August deadline). As soon as I receive all my information I will continue the fight.

    I too received a letter for a card I took out back in 2001. They have listed the following from their online sales process:-

    - does not require you to take repayment protection insurance as a condition of obtaining the credit card

    - does not provide an advisory service

    - required to to positively confirm that you wished to purchase this policy during the online application

    - provided full terms and conditions of the policy and requetsed they were read before submitting

    In adidtion they have conducted a review of the documentation you viewed during the sale. We are satisfied that the documentation presented accurately described the scope of the policy, and the information necessary to inform you of the terms and conditions of the policy.

    Any advice as to what my next step should be folks as I believe that people have still been getting refunds despite receiving the same information from Egg??
