is it possible the new engine is not fit for purpose under the sale of goods act? do I then have to pay for the removal and refitting of a good engine?0

Ok, back on topic a little.... your mechanic should have tested the unit before installing it. It was a silly decision not to do this. Regardless of the description of the engine you were sold some basic checks would confirm its overall condition.
The company supplying the engine with guarantee should (through goodwill if nothing else), if returned to them and the engine is found to be siezed also pay you the cost of then removing the engine despite it not having been tested before installation. I doubt you have any real legal grounds to get this to happen - as far as I know they would simply have to refund your money for the engine or supply a working unit but it's certainly worth speaking to them about it.0 -

i used to sell s/h engines
used to be a steady away business too
i always marked everything in case i had a comeback
bought a van too to deliver
everything went swimming till one day i had a call to say the engine i had delivered was no good,now unbeknown to the seller at this stage this very engine was my user the week before but the engine was worth more than the car (a ford onion with 16cvh)
i went to venders house where car was not a mean feat but im a man of my word,anyway yes the head was the one i had supplied but the mechanic had only used this bit and nailed it onto the duff customers engine as he couldnt be bothered fittingh the lot even though he invoiced and said he had
upshot is i had the mechanic on the phone telling me i was wrong and he was coming down to rip my head off for suggesting he was a lier
now i had one of those suitcase mobile phones in the van and phoned the police to tell them where i was and that i had been threatened with violence,i was in a culdesac which was a bit frightening
anyway i showed my customer where the stamp marks should have been on the block and waited half an hour for the thief to turn up
he never did
anyone fitting an engine would turn it over by hand before fitting just to ascertain it was free and also remove the clutch to confirm its not seized
its also highly unusual to get an engine with ancilleries very unusual to the point ive never seen it
So to OP something is wrong here,
i cant give you an answer to who it is but i can tell you i closed my engine business after that do i dont go to earn a living and have violence threatened0 -
It would be unusual not to turn the engine over by hand before fitting it.
If you are changing the clutch you'll notice if the flywheel is moving, and if it's totally siezed you'll feel it as you unbolt the cover from the plates, and put it back together.0 -
Personally, I don't think you will get anywhere persuing the engine supplier except to get a replacement engine, but in the absence of any more useful answers, it might be worth calling your local CAB to check your legal rights? Also, as there is arguement to say the mechanic really should have checked the basics on the engine, will he do a deal and discount the removal and refitting of a replacement?
How did you order the engine - depending on the answer, distance selling regs might mean you're entitled to a refund of return carriage costs?
As for the posters extolling the virtues of hindsight - this forum probably wouldn't exist if we all had that - I'd have worked harder at school, listened to my Dad, not married my first wife etc etc... if only i could go back 20 years....0 -
It's not so much hindsight, just that it would be hard to fit an engine without turning it partly over, so it doesn't seem clear cut as to why it was only discovered at the end.
Maybe more info is needed on why the engine is locked up?
Is it the swapped starter not working, the new clutch fouling somewhere, or is it the engine bores rusted solid?0 -
