DRO advice!

Hi all, been reading the boards for a while but finally decided to post!

Since January 2011 I have been dealing with the CAB's Debt Specialist Team in regards to a DRO.

I am at the final stage now of getting the application completed, I am going to meet my case worker tomorrow to get everything finalised with upto date balances etc.

Can anyone tell me how long it takes from applying to be accepted?

Im hoping all goes well tomorrow as even though I know I qualify, I am a worrier lol

I have had council tax asking me why its taking so long (8 months since initial meeting at the CAB) All i can think is its because my case worker is only at my CAB 1 day a week! Can not wait to release this from my shoulders!!

  • A close relative of mine applied for a DRO at the start of June and that was after she had everything finalised with CAB and paid the £90 fee. The Court Service only wrote to her 10 days ago to tell her its been approved. It seems they may be quite busy at the moment.

Hope everything goes well for you. Best of luck :)

  • About 10 weeks Caz. Don't worry about your creditors, they can wait, they have no choice as they DRO has to be dealt with in Court by an OR. You'll still get the phone calls, letters, demands from DCA's etc but when you get your letter of approval just give your creditors the reference number and they'll soon stop ringing.

    10 WEEKS :O

Mines been going on for 8 months!!!! Its been driving me mad! I see people mentioning as little as weeks from start to finish, just seems everyone been luckier than me!

Ill be glad when council tax can no longer use an attatchment to earnings, that's taking an average of £130 from me a month, and then my current year on top of that! Of course there is nothing that can be done for that before the DRO is granted...i just hope that it is accepted, if its not then i dont know what im going to do!

Im presuming the CAB wouldn't let me pay the £90 and apply if they didn't think i was going to qualify though?

If your debt is less than £15k and CAB have told you that you qualify then I don't see why not. There are about 6 CAB's in our town alone and quite a number of advisors in each so thats probably why it was so quick. Once the £90 is paid then its out of their hands but I can't see you being rejected. I hope not anyway. Ask CAB the next time your in how busy the Court Service are in your area. They usually are 'in the know' about these things and could tell you roughly how long you'll wait. Or go ahead and ring your local court and ask.

    Hi Scarlett,

    Thanks for your reply!

Yes tomorrow is the day that we get the online form done! My case worker hasn't asked me to bring the money with me, she just said that i will receive a letter with a barcode and then need to just go to the post office within 10 days of the form being submitted to pay it? She said they can't take the money there and it has to be done at a post office! I'd rather get it done tomorrow then hopefully by monday my name will be on that register! (not that its a good thing to have your name on, but it is in the situation im in! lol)

Im going to take it with me so i can sort it straight after the meeting tomorrow or whever she says to!

I currently am on an attatchment to earnings for council tax, my work is due to put the wages through on tuesday to pay me on thursday if my name is on the list on tuesday can i tell my work not to deduct it or how does it work? will they still have to do the attatchment this time, obviously only if my name is on the insolvency register on tuesday as wednesday will be too late? sorry for all the questions, im a terrible worrier and i have this tendency to want to know things before i go somewhere to find out lmao

yeh i understand that but this payment is out of my hands!

Its an attatchment to earnings on a liability order from council tax, it is taken directly out of my wages before i even see it!? which is why my question related to how does it work, can my employee just take my word for it that they aren't to take it esp as on that day i wont have received a letter from the insolvency people about my dro being approved?

sorry if i didn't make much sense first time round lol
