The OP hasn't taken delivery of the item yet. If you order a wardrobe for delivery from Argos and it then goes out of stock, surely you just accept the refund. You don't go running to the police or whatever saying "argos have stolen my wardrobe!" I realise this is an exaggeration but doesn't the same principle apply? A bike never became the OP's property yet so as long as Halfords refund then there's no loss to the OP.
Hang on a minute - didn't the OP say he had paid in full for the bike? Surely it was his property - the store just said they would keep it (Safely!) for him as part of their usual service. They have somehow lost/sold/otherwise disposed of his property and it seems entirely fair that they now move heaven and earth to rectify the matter - its all very well saying mistakes happen but that isn't really a satisfactory response to the OPs' loss.ELITE 5:2

Halfords can move bikes between stores either on their own transport or by courier. They are not supposed to use courier but as it is a CS issue they should do it. If the store will not sort it then phone their CS, it will get sorted then.
They do not sell you a particular bike but reserve one of the ten or so the system shows as in stock but as their stock file is [STRIKE]usually[/STRIKE] very poorly managed in many stores when it comes to the last one it is often not there. They will only be selling bikes from stock at the moment as the christmas allocations, which they can reserve against, will not be sorted yet.0 -
Ok, firstly may I thank everybody for the information they supplied me with yesterday evening. I went to the Halfords store that I purchased the bike from fully armed with information and legislation that you guys gave to me yesterday. after quoting some of you the manager actually bricked himself. He was the one who said that he would put the bicycle away safely until Christmas. Whether he was panicking or just flustered I managed with all of your help to get a 2010 model for the same price as I paid for the 2009 one as a gesture of good will on their behalf. I would again like to thank all of you who were so helpful regarding this matter, don't know if I could have done it without your helpful information.
