i dont think they send your licence to the dvla i think it just goes to the court? and they made a mistake and sent it back without waiting for the payment to clear, we sent it and got it back all in a week

The officer you produce it to at the police station for this latest offence should make a note on the HORT/2 form of the number of points, as he will be checking your partners licence. You should still get a summons in the post.

One other thing to consider if he does hang on to his license this time is that its very likely that if he drives a company vehicle for his work that the company insurance policy will no longer cover him with 12 points, so he'll be effectively banned from driving company vehicles.
