totting up ban?

hi a little confused, my oh has just got another 3 points for using a mobile (stupid i know) he told the officer he already had nine points, he checked with dvla they said he only had six, so he said he had to give him the points.
He just got his licence back so maybe they haven't updated it yet
he has 3 points for parking on zig-zags
3 point for 35 in 30
3 points for 50 in 40 ( this was a temp speed limit he didn't notice the sign, no excuse i know)
and now 3 points for mobile phone use
my question is what happens now i thought you got banned for 12 points?
will he have to go to court? all points received in scotland will he have to go to cout there ( we live in cheshire )
if he gets banned i think he will lose his job as he needs to drive for work as he works all over the country would this change anything in court, im so worried i cant believe hes been so stupid!!

He sounds a nightmare driver, speeding and now using his phone as well. He should be off the road before he kills someone.I'm retiring at 55. You can but dream.0

Was one set of points received more than 3 years ago? Points stay on your license for 4 years (or more depending on the offence) but only count for a totting up ban for 3 years (from the date of the offence).0

if he was banned i can't see the DVLA sending his license back. I presume they keep hold if it?0

all points received in the last year 6 within the last two weeks, they are so on the ball in scotland i told him to be careful!!0

It's easy to accumulate points especially if you do a lot of driving. Though there is no excuse for the mobile!
I got 3 for doing 35 in a 30 as well. In fact I had only just increased speed to evade a hazard but I didn't bother arguing. I suspect that like a lot of people it is more down to luck that I haven't been done more - even though I don't consider myself a speed merchant. If you want a swarm of angry drivers on your tail - just try rigorously keeping to the speed limit! Sadly my area doesn't offer a speed awareness course as an alternative to points.

It's easy to accumulate points especially if you do a lot of driving.
It's also easy not to accumulate points if you take care and drive according to the rules. Anyone who uses the excuse that they drive a lot should get banned for twice as long because they should know better.0 -

Absolute utter rubbish. I did over 100,000 miles a year and as high as 150,000 some yeats as a lorry driver driving all over the UK and never got any points. I have done in excess of 1.8 million miles without any points. The last few years I've not done as much mileage but am still doing over 17k a year. I've only ever had 3 points on my licence since I got my provisional 23 years ago.0 -
i was asking for advice on what will happen does anyone have any?, im not interested in how long people have driven without any points, and only 3 points in 23yrs wow you've been very lucky to just get caught the once haven't you.0

He can plead "exceptional hardship" and probably avoid a ban if losing his license would mean losing his job and not being able to support his family. They'll fine him a good few hundred quid instead though. Go to pepipoo.com where you'll get better, less condescending advice from non-tossbags.0
