totting up ban?

Absolute utter rubbish. I did over 100,000 miles a year and as high as 150,000 some yeats as a lorry driver driving all over the UK and never got any points. I have done in excess of 1.8 million miles without any points. The last few years I've not done as much mileage but am still doing over 17k a year. I've only ever had 3 points on my licence since I got my provisional 23 years ago.
Then you have been lucky.i was asking for advice on what will happen does anyone have any?, im not interested in how long people have driven without any points, and only 3 points in 23yrs wow you've been very lucky to just get caught the once haven't you.
Get a decent specialist solicitor and he should be able to avoid a ban. I would not want his insurance bill for the next few years though.0 -
If his last set of 3 pts was only a couple of weeks ago, they will not have reached the DVLA yet, so - assuming he has just been gven a ticket (FPN) for this latest offence ..... when he pays it and the ticket goes through the system, the fact he already has 9 pts will be flagged up and his payment/licence will be returned to him. This will be followed by a summons, he can then attend court and make his hardship plea to try and avoid the automatic 6 months ban.0

do you always get fined as well as banned?0

All these people who have been riding the roads a lifetime and never once exceeded the speed limit even by a few miles. Clearly I am in the company of saints. Cough...0

Yes. If the judge lets you keep your licence the fine will be very large.
The fine will be more than a FPN, but not enormous. The exceptional hardship plea may allow him to keep his license and not lose it under the totting rule but insurance companies will charge the earth to insure him, and there is a good chance his current insurer will refuse to continue to insure with 12 points.
Still, conversely it doesn't sound like you'll have to worry about it for much longer as the way he's racking up points at the moment he'll be banned soon anyway. It sounds to me like you should stop worrying about him keeping his license and start planning for the inevitable ban whether it happens on this visit to court or not.Hi, we’ve had to remove your signature. not really, but parking on zigzags and using mobiles while driving are easily avoidable and not really a lapse in concentration or the like0 -
If he got 3 points only 2 weeks ago, should his licence not still be with either the police or the dvla?
IF so, when he goes to produce his docs he won't be able to, and they should then inform the traffic cju who should send him a court date anyway
Unless it's a very different system in scotland?0 -
Ignore that tossbag. There is always one (sometimes two or three).
He can plead "exceptional hardship" and probably avoid a ban if losing his license would mean losing his job and not being able to support his family. They'll fine him a good few hundred quid instead though. Go to pepipoo.com where you'll get better, less condescending advice from non-tossbags.
How is he a tossbag? Why is it so acceptable to put others lives at risk if you are driving? If I posted up here that I was arrested for target shooting at my local park, looking for advice on how to get off with it because I am a good shot so unlikely to miss and kill someone I would rightly get abused on here.
If he has 9 points then why the hell had he not learned to drive properly with due care and attention, not whilst talking on his mobile. It is no surprise how many people are killed on the roads given the lack of awareness and ability of so many drivers. I do not claim to never speed, but I do so only when it is safe (ie never in towns and villages) and am concentrating fully when doing so, therefore will spot a police car or camera before I get caught. There should be less emphasis put on speed and more on getting the terrible drivers off the road.
The problem is people like you who think that it is ok to drive like a numpty and try to find a way of keeping these people on the road so they can continue to drive unaware of what is going on around them until they eventually kill or ruin somebodys life.
